Law no. 360/2023 enters into force on September 1, 2024. So, in about six months, the pensions established according to the previous legislation and which were recalculated using the new formula provided by the new law will be automatically recalculated, claim the representatives of the County Pension House ( CJP) Constanta. Until then, the pension houses are obliged to receive any request from natural persons – insured or pensioners, and will resolve them according to the legal provisions in force. Careful! No application can be refused from persons who wish to submit a document/certificate that does not already exist in the pension file.
People are, however, afraid that with the implementation of the new law, their pensions will not be reduced. “I know cases in which some people did not receive more money when requesting the recalculation of their pensions. Others brought the necessary documents from the companies they worked for and only received 50-60 lei more”, Tănase P told us.
What happens from the autumn with the disability pension
Regarding the disability pension, according to the Ministry of Labour, it is due to people who have completed periods of contributory contributions in the public pension system, who have not reached the standard retirement age and who have reduced work capacity. Until now, the assimilated periods, which included the one in which someone benefited from the disability pension, were considered periods for which no social security contributions were due or paid and which are assimilated to the contribution period in the public pension system . According to the current law, the assimilated periods were those non-contributory periods, but which the legislator considered assimilated to the pension contribution period. The new law also states that for any of the degrees of disability, depending on the reduction of work capacity and the type of work relationship, the work capacity can be considered preserved for certain professional activities. There is also dissatisfaction regarding the retirement age, which should be the same for women as for men, i.e. 65 years.
Under these conditions, as expected, the population began to react. “Why should we retire at the age of 65? Well, at the age of 65 there are people who are no longer able to work at all. How can I last so long in the labor field?, commented Flavia C. What do the CJP Constanţa representatives say about the changes in the system?
“People come to the office and very often ask us questions about the retirement age and whether, following the recalculation, their pensions will increase or decrease. Currently, the retirement age is 63 for women and 65 for men. Gradually, this will reach 65 years and for women. We cannot yet provide any further information. We are waiting for the necessary regulations from Bucharest, from the Ministry of Labor and the National House of Public Pensions. It is certain that people come to us scared, they ask us what they will do in the fall, they ask for information. Regarding the recalculations, we tell everyone that the recalculation of pensions will be done ex officio, for everyone”, declared the spokesperson of the Constanţa County Pension House, Kristina Mutiş.
