In a previous article (click here for the article), we showed that in the area of the Lobogo guesthouse in Homorod Bai, the construction of a new body of the guesthouse has begun. From the information sent by the National Environmental Guard – Harghita County Commissionerate, it is found that “following the control carried out on 11.01.2024, on the location identified by GPS coordinates 46.349803 – 25.472475, two constructions were identified without possession of documents regulation from the point of view of environmental protection, which is issued by the regulatory authority (APM Harghita), for which GNM-CJ Harghita applied a contravention sanction and a complementary sanction of canceling the works and bringing the land to its original state”.
We requested a point of view from the Vlăhița Town Hall, to which the resort belongs and in which we are confirmed the existence of “building permit no. 19 of 19.11.2021”, being then listed the “documents” that were the basis of its issuance. Even with a superficial reading, it can be seen that these are extremely old documents (issued in 2014-2015) and that should not have been accepted in the documentation for issuing the building permit.
Therefore, the Vlăhita City Hall either does not know how to do its job and erroneously issued the authorization, or pretended it was raining and accepted any paper that the beneficiary sent – both options being likely to generate problems of order legal for the institution – in case someone does a check.
Since we notice that the works continue on the new building, despite the demolition measures ordered by GNM-CJ Harghita, we requested and obtained a new point of view from the mentioned institution, in which we are told that “Against the minutes of ascertainment and sanctioning of of the contravention, which also provides for the complementary sanction of canceling the works, a complaint was filed with the court by the company. According to the provisions of Ordinance no. 2/2001, regarding the legal regime of contraventions, the complaint suspends execution”.
The conclusion: the “Lobogo” case is a textbook case in which anyone with the necessary connections and financial resources can build anything, anywhere and anyway.
We hope that, having the precedent of the tragic incident at “Ferma Dacilor”, where the necessary authorities and approvals were also missing, the competent state authorities such as ISC, Prefecture, MAI/ISU, Environmental Guard, Environmental Protection Agency, etc., will act decisively for the restoration of legality in the case of “Lobogo”, without allowing themselves to be intimidated and/or influenced.
The case remains in our attention.
