Outrage at the policeman. A man at the CFR Brăila train station threatened a policeman and did not calm down even at the headquarters of the Trnasporturi Police. The act was committed in December last year, and now the defendant Georgel NM (name posted on the court’s website) was sent to court by prosecutors of the Prosecutor’s Office attached to the Brăila Court.
According to the investigators, the defendant was investigated in a state of preventive arrest for committing the crime of insult, an act provided for by art. 257 of the Criminal Code, with the application of art. 41 of the Criminal Code. “On December 20, 2023, at around 06:00, while he was in the waiting room of the Brăila CFR Station, the defendant addressed threats of acts of violence and the death of the ML police officer, who was in the exercise of his duties. Later, after handcuffing and driving him to the headquarters of the Brăila Railway Transport Police Station, NMG continued to address the same kind of threats to the ML police officer”, the prosecutors established.
The defendant was arrested on December 22, when the court accepted the proposal made by the Prosecutor’s Office attached to Brăila Court and ordered the preventive arrest of the defendant NM for a period of 30 days, until January 20, 2024, inclusive Georgel, investigated for committing the crime of insult. The preventive arrest warrant was issued in the defendant’s name, and he was incarcerated in the Brăila Detention and Preventive Detention Center.
Release was ordered, but prosecutors contested the measure
As shown on the court’s website, at the meeting of March 14, the magistrates of Brăila Court revoked the preventive arrest of the defendant NM Georgel and ordered his release, if he is not under the power of another warrant of execution or preventive arrest on the date of finality of this conclusion.
An appeal could be filed in the case, and the prosecutors of the Prosecutor’s Office attached to the Brăila Court did not think too much.
At the meeting on March 19, the judges of the Brăila Court annulled the decision of the first instance. The appeal filed by the Prosecutor’s Office attached to the Brăila Court, against the conclusion of the meeting dated 03.14.2024, pronounced at the Brăila Court, was accepted as founded. “On retrial: the measure of preventive arrest of the defendant NM Georgel, investigated for committing the crime of insult, is maintained. Provides for the advancement of the ex officio lawyer’s fee for the defendant from the Ministry of Justice fund. Definitive”is the solution pronounced at the Brăila Court and posted on the court’s website.
