The lawyer of the German citizen who took the six-year-old child from Danciulești commune, Gorj county, to Germany, claims that everything was done legally and that he is in the preliminary adoption procedure.

Alexandru Călinoiu, the lawyer of the German citizen, told how the German citizen met the family from Gorj county: “All the steps were taken perfectly legally and there is no crime. If there are some seemingly illegal matters, they are small things that can be overlooked. In fact, the child’s two parents have other children and have a slightly more precarious material situation. The gentleman from Germany is the administrator of a company and has employees from Romania. They invited him to see Romania and he liked it. By chance, he met the children, sitting near them. He gave them sweets as is usually given to children. There was an attachment between the children and you, so he launched the intention to open the adoption procedures”, said the German’s lawyer, Alexandru Călinoiu.

Procuring in the name of a Romanian, work colleague of the German citizen

The lawyer claims that a power of attorney was drawn up in the name of a Romanian citizen, co-worker of the German: “To adopt a child, one must see if there is compatibility. He found that there was compatibility in the country and wanted to see if the little boy wanted to go to Germany to see if there was compatibility there as well. He is a foreign citizen and cannot take a child out of the country. He called a co-worker perfectly legally and they went to a notary in Craiova to agree that for a limited period of time the co-worker should go with a power of attorney. Because the two parents did not know how to sign, it was necessary to bring two witnesses”, explained the lawyer Alexandru Călinoiu. The lawyer also says that the border crossing was done under legal conditions and that the authorities in Germany took the measure of taking over the child, when they found out that there was no adoption decision.

“It went through the Nădlac customs perfectly legally with that power of attorney. The checks were done and they were out of customs. He stayed for a while in Germany. The child was declared in Germany and transferred to the institutions there. The representatives of the institutions asked him for the adoption decision, but the German citizen said that he did not have it and that he was in the preliminary adoption procedures. She was told that the child remains in the care of the authorities until they resolve the matter. He returned to Romania and continues the adoption process. When the two parents (n. ed. potential adoptive parents) came to the country, it was found that a criminal procedure had started and the other two children were taken into emergency foster care by DGASPC Gorj”, lawyer Alexandru Călinoiu also mentioned.

The family house in Danciulești, rehabilitated

In addition, the representative of the German who wants to adopt the child says that he has started renovation work on the family home in Danciulești, so that the other two children can return to the family.

“I went and saw the conditions of the family in Dănciulesti and they are deficient. I talked with a group of people from the area to start the rehabilitation work of the house in order to receive the other two children”, added the lawyer.
He also says that no payment was made to the family for the adoption: “There is no payment of any kind. It’s just the expenses that were made for clothes, food and other things. State institutions do not allow illegal exit from the country”.

The child’s father claims that he really gave his consent for the boy to be taken out of Romania, through a power of attorney made at the notary, and that his son was to be adopted, but that he would not have received any money for him.

Instead, an uncle of the child says that he would have paid for his adoption: “They sold the child to two people. You don’t have to give them the baby anymore. They received 40 million old lei once. I posted on Facebook, be careful that the child is at the border and is crossing fraudulently”, said the uncle for Pro Tv.

DIICOT is investigating this case

DIICOT announced that “in rem” checks are being carried out in this case: “On the role of DIICOT – Gorj Territorial Office, a criminal case was registered on 04.08.2024 regarding the commission of the crime of trafficking minors, following a notification by the General Directorate of Child Assistance and Protection Gorj. The investigations are carried out in rem, and this stage does not mean the formulation of accusations against a person/s, but establishes the procedural framework necessary to gather the evidence for the correct and complete establishment of the state of facts to allow the adoption of a legal and thorough solution in the case”. DIICOT sent in a press release.
