The Gorj County Council won the trial with the former prefect Iulian Popescu, the control order being annulled issued at the beginning of the year.

The County Council challenged in court the prefect’s order, by which he demanded a general control at the Gorj County Council. The court’s solution, in short, is the following: Admit the action of the County Council and cancel order no. 12 of 10.01.2024, issued by the prefecture. Type of solution: Rejects the request for suspension requested by the prefecture. Therefore, the court recognized that that control order was illegal, and the legal team from the Gorj County Council was right when it classified this action as the result of an excess of power on the part of the former prefect. The court’s recent decision to annul order no. 12, issued by Gorj Prefecture, is not only a legal victory for the County Council, but also a clear lesson about the limits of administrative power and the importance of law enforcement even by those who are meant to enforce it.

By requesting a general control at the Gorj County Council, without presenting well-founded and concrete reasons to justify such a measure, the former prefect abused the power conferred by his position, defying the basic principles of justice and administrative fairness. This unjustified action highlights behavior that cannot be tolerated in a public administration that claims to be transparent and accountable. Excess of power, in any form, is harmful not only for the directly targeted institutions, but also for citizens’ trust in the integrity and efficiency of state institutions. The court, through its decision, not only repaired an injustice, but also sent a strong signal that such behavior will not be tolerated.

It is imperative that such situations are taken seriously and that responsibilities are clearly defined and respected. Cases like this not only erode the foundations of democratic governance, but also undermine the principles of transparency and accountability that should govern all actions of public officials. In conclusion, it is essential to ensure that such abuses do not go unpunished and that the mechanisms of checks and balances within the administration work effectively, to protect public interests and to prevent any attempt to undermine the rule of law” the County Council announced Gorge.
