The magistrates of the Alba Iulia Court terminated the trial against Agra s (the legal entity) for the crime of theft. The company was sent to court for theft in continuous form (three acts) of electricity.

From the time it was sent to court until March 27, 2024, the date on which the trial was closed, the company’s representatives reconciled with those of the Electrica SDEE company.

The damage was 133,834.27 lei, around 26,000 euros.

The arraignment took place during 2023, and the case passed the preliminary chamber measures and exceptions on November 10.

After the magistrates dismissed the theft case, the court’s reasoning became public and was available on the courts’ portal.

What started the process

The SDEE inspectors discovered at three Agra’s stores that the electricity supply installation had unauthorized interventions.

The measuring and protection block (BMPT) was unsealed, “and on the electrical contacts of the electricity meter, on three phases, three copper shunts of the “bridge bar” type were mounted between the input-output terminals at each of the three phases of the electricity meter, electricity being fraudulently consumed”, at a store, the magistrates noted.

At the other two shops, on the electrical contacts of the electricity meter, on two phases, two copper conductors with a section of approximately 16 mm were mounted between the input-output terminals of each of the two phases of the energy meter electric, electricity being consumed, the magistrates specified.

Why was the company sued?

during the period 13.07.2017 – 13.06.2020, at the work point located in Alba Iulia, Vasile Goldiș str., no. 19, taking advantage of the modification of the measurement and protection block (BMPT), stole electricity causing the injured person SDEE a damage in the amount of 11 367.59 lei,

– during the period 13.06.2017 – 13.06.2020, at the work point located in Alba Iulia, bd. of the 1989 Revolution, taking advantage of the modification of the measurement and protection block (BMPT), stole electricity causing the injured person SDEE a damage in the amount of 79,375.86 lei,

– in the period 13.09.2017 – 13.06.2020, at the work point located in Alba Iulia, taking advantage of the modification of the measurement and protection block (BMPT), stole electricity causing the injured person SDEE a damage in the amount of 18 318.94 lei” , it is stated in the document issued by the magistrates of the Alba Iulia Court.

Reconciliation

In front of the court, the representatives of the two companies submitted a notarial document showing that they have reconciled.

More precisely, “the defendant paid the civil party the amount of 133,834.27 lei, composed of the damage in the amount of 109,062.39 lei and the amount of 24,771.88 lei representing the indexation with the inflation rate of the debt. The civil side accepted this payment, recorded as such in the authentic notarial document of reconciliation of the parties”, noted the judges.

As a result, the file was closed.
