The sentence was given on Wednesday by the Oradea Court, which took into account the fact that the exhibitionist committed the act in broad daylight, in front of a woman and her daughter and near a group of children who were playing.
Tibor Jozsef Toth was detained by the police on July 7, 2023, after a woman called 112 and complained that the individual had committed explicit sexual acts. The complainant claimed that while she was with her 6-year-old daughter in Olosig Park taking pictures, she observed the individual on a bench making obscene gestures and throwing pebbles at her.
The woman took her daughter out of the area and left her in the care of a friend, after which she returned because there were three little girls playing near the exhibitionist. He called the police and soon a crew picked up Jozsef Toth. A well-known individual among the street people of Oradea, the man had only one excuse before the agents: the woman who had stopped in front of him was scantily clad.
Deed of increased gravity
Accused of outrage against good morals, Toth was tried in absentia, because he could not be found to be brought before the court. The judge of the case categorized the act committed by the man in a children’s park, at noon, as “highly serious”.
“Children’s exposure to such sexual acts can prove traumatic and can substantially modify their psychological mechanisms, affecting the good development of their mental health and creating difficulties for them to adopt, in the future, a normal and healthy behavior”, the decision states Oradea Court, published on the Rejust portal.
For this reason, Jozsef Toth was sentenced to life imprisonment. He still has the chance to appeal, which he can declare within 10 days.
