A driver who was fined by the police, after he was pulled over on the right on the A1 highway, within the radius of Alba county, went to court. The reason? He wanted to get rid of the 1305 lei fine and not to have his card confiscated for 90 days.
He was sanctioned after several technical problems were discovered during the inspection of the van he was driving.
The driver said he was unaware of the car’s problems. The sanctioning took place on March 9, 2022. A court decision came two years later, on April 25, 2024. The case was judged by the magistrates of Sebeș.
What happened
The man was pulled over for not wearing a seat belt. Then after his car was checked by a specialist from RAR, technical deficiencies were discovered.
“He was sanctioned, because on April 9, 2022, at 11:15 a.m., he drove the Mercedes van, on Highway Al, km. 316, without respecting the obligation to wear the safety belt connected to the device.
Also, following the control carried out by the RAR specialist, it was found that the van driven by the petitioner had major technical deficiencies both in the lighting system and in the steering system”, noted the magistrates.

In his defence, the man said he did not know about the defects in the car when he bought it.
He also stated that the ITP was valid.
What the magistrates decided
The magistrates ruled in favor of the investigating officer who fined the man.
“The court notes that the facts seized by the investigating agent constitute contraventions regardless of the moment of the purchase of the car, without having anything to do with the quality of the owner.
The driver must make sure before driving that the car has no defects and the ones found do not represent hidden defects, but some that could and should have been noticed by the petitioner at the time of purchasing the car.
The fact that the car had a valid ITP is not relevant as long as no sanction was applied for the lack of periodic technical verification”, the magistrates noted.
As a result, they rejected his request to cancel the fine.
At the moment the decision is not final and can be appealed.
