The Minister of Energy, Sebastian Burduja, announced on Thursday that he will repeal the sun tax for prosumers.

It is about the emergency ordinance that allowed ANRE to charge prosumers starting December 1, 2026, if they exceeded 8% of the total energy production capacities in Romania.

“As I promised, I proposed the repeal of the possibility of imposing that tax on the sun, the article that from 2026 would have given ANRE the possibility to impose a tax on prosumers.

Today there are more than 120,000 prosumers in Romania, with an installed power of more than 1500 MW”, declared, on Thursday, the Minister of Energy, Sebastian Burduja.

The government explained, upon the adoption of this GEO, two years ago, that it intended not to implement this measure, but only wanted to transpose a European directive into legislation.

At the beginning of February, the Association of Prosumers and Energy Communities (APCE) asked the authorities to remove this paragraph from the law, so that there is no risk that this “solar tax” (self-consumption – no) will be introduced.

Currently, the legislation allows the authorities to introduce this tax for several categories of prosumers, such as beneficiaries of the Casa Verde, Electric Up or RepowerEU programs, and from 2026 for all categories of prosumers.
