Rule for absolutely all drivers in Romania. In the case of a road accident, in most cases, we are not allowed to leave the scene of the accident. However, there are exceptions. Which are these?

Leaving the scene of the accident is punishable by imprisonment from 2 to 7 years

When a road accident occurs, the drivers involved have various legal obligations. One of the most important is not to leave the scene of the accident. The law is very clear on this, and failure to comply can have serious consequences.

It is essential that everyone involved in a road traffic accident follows these rules, as failure to comply with legal obligations can have serious consequences for everyone involved.

According to the law, leaving the scene of the accident without the consent of the police or the prosecutor who investigates the crime scene is considered a crime and is punishable by imprisonment from 2 to 7 years, establishes Art. 338 (1) of GEO 195/2002.

The same penalty is also applied in case of altering or erasing traces from the scene of an accident resulting in the killing or injury of a person.

However, there are exceptions provided by law and in these cases leaving the scene of the accident does not constitute a crime. These exceptions include, for example, the situation where the accident causes only material damage.

When can we still leave the scene of the accident?

Thus, the situations in which, according to the law, it is not a crime to leave the scene of the accident are the following:

  • following the accident, only material damage occurred;
  • the driver of the vehicle, in the absence of other means of transport, transports the injured persons himself to the nearest health facility in a position to provide the necessary medical assistance and to which he declared the personal identity data and the registration or registration number of the vehicle driven, recorded in a special register, if he returns immediately to the scene of the accident;
  • the driver of the vehicle with a priority traffic regime immediately informs the police, and after finishing the mission, he presents himself at the headquarters of the police unit in whose jurisdiction the accident occurred, in order to draw up the verification documents;
  • the victim leaves the scene and the driver of the vehicle immediately reports the event to the nearest police station.

That doesn’t mean, however, that if you’ve hit another car, you can just keep going. You must stop and make sure no one is injured.

It is important to note that even if the accident only causes property damage, the drivers involved have 24 hours to report the accident to the police.
