According to the Public Information and Media Relations Office of the Prosecutor’s Office attached to the Constanța District Court, on 26.03.2024 the case prosecutor from the Prosecutor’s Office attached to the Constanța District Court proposed to the judge of rights and freedoms of the Constanța District Court taking the preventive arrest measurefor a period of 30 days, starting on 26.03.2024, until 24.04.2024, inclusive, of the defendant RDMinvestigated for committing the crimes of driving a vehicle without a driver’s license, prev. of art. 335 para. 1 of C. pen., and leaving the scene of the accident or modifying or erasing its traces, previous of art. 338 para. 1 of C. pen., both with application. Art. 38 para. 1 and art. 41 para. 1 of C. pen.
Following the checks carried out, it was established that, on 25.03.2024, at 00:40, the defendant RDM, who does not hold a driving license for any category of motor vehicle, drove a car on DN 38 in the municipality of Constanța, and at the intersection with DJ 381 did not stop at the legal stop signal given by a police officer.
“The vehicle in question continued its movement, being followed by a police vehicle on DJ 381 and DC 1A, where the defendant lost control of it, so the vehicle left the road surface, overturned and stopped in a ditch in the proximity of the Danube-Black Sea canal.
The occupant of the right-front seat of the car, witness CVD, was found at the scene, who, following the accident, suffered traumatic injuries requiring 16-18 days of medical care.
The defendant left the scene of the accident until the arrival of the police and later presented himself, on 25.03.2024, at 18:10, at the headquarters of the Topraisar Police Station, where he admitted committing the acts. He was tested with the breathalyzer, the result being negative” – stated the Public Information and Media Relations Office of the Prosecutor’s Office attached to the Constanța Court.
It was also noted that the defendant RDM committed the acts in a state of post-execution recidivism, as he was previously sentenced to custodial and non-custodial sentences for committing similar crimes against road safety.

We specify that the initiation of the criminal action, detention and preventive arrest represent stages and measures during the criminal process, regulated by the Code of Criminal Procedure, with the aim of creating the appropriate procedural framework for the administration of evidence, activities that cannot, under any circumstances, to defeat the constitutional principle of the presumption of innocence” – the investigators also mentioned.
