PSD MP Gorj Mihai Weber and his colleague Alfred Simonis proposed a draft law in the Senate, through which special protection measures are established for military objectives. The purpose of this project is to create a mechanism to ensure the protection of military objectives used in national security activities.

Their proposal provides for the establishment, by decision of the Supreme Council of National Defense (CSAT), of areas with a special protection regime in the outskirts of the military objectives, within a radius of 2,400 meters.

The project aims to introduce clear regulations regarding prohibited activities in these areas, to oblige the authorities to integrate this information in urban planning and cadastre documentation, and to provide compensation for those affected by the restrictions imposed by law.

Areas with a special protection regime prohibit construction and activities that could affect the security of military objectives. The list of military objectives and protection zones will be established by decision of the CSAT, and institutions in the field of national defense and security must communicate information about these zones to the local authorities for their integration in urban planning documents.

The owners affected by these restrictions will receive compensation, and the details regarding their assessment and payment will be established in methodological norms developed by the Government.

The bill has been registered in the Senate, and the Chamber of Deputies will be responsible for its final adoption.

The county councils whose administrative territories fall under the provisions of this law have the obligation to:

“a) to take over, in the county territory development documentation, the prohibitions necessary for the protection of military objectives;

b) to ensure the adoption, in the general urban plans and in the related regulations of the administrative-territorial units whose territories are in the area with special protection regime, of the prohibitions necessary for the protection of military objectives”.

In addition, “the local public administration authorities of the communes, cities and municipalities whose administrative territories are in the area with special protection regime have the obligation to take over, in the general urban plans and in the related regulations, the prohibitions necessary for the protection of military objectives, within no more than 60 days after receiving the information provided for in art. 4 para. (2)”.

“Within 15 days from taking over the prohibitions necessary for the protection of military objectives, the authorities provided for in para. (2) transmit to the County Council to which they belong the urban plans and their related regulations, approved and approved according to the law, in order for it to fulfill its obligations”, the draft law also provides.

The areas with a special protection regime taken over in the general urban plans and in their related regulations are published by the authorities on their own website, with the mention of the established prohibitions.

The provisions of this law are applied “including to lands located in areas with a special protection regime, passed within the urban area, on the surface of which no construction was built until the date of entry into force of this law”, and “property owners who have obtained authorization to building before the date of entry into force of this law will be compensated fairly and in advance for the damages caused”.
