The prosecutors within National Anticorruption Directorate – Territorial Service Oradea ordered the referral to court, under judicial control, a Nadiei Florentina Racz, former deputy chief inspector of the Territorial Labor Inspectorate (ITM) Bihorfor committing the crimes of: bribery, allowing unauthorized persons access to information that is not intended for publicity, in order to obtain money, goods or other improper benefits for oneself or for another (two acts).

In the drawn up indictment, the prosecutors retained, in essence, the following state of facts:

 

Between February 14, 2022 and October 17, 2023, in the context of carrying out checks at several commercial companies, the defendant Racz Nadia Florentina and three of her subordinates, namely Buhaș Aurica, Hriscu Daniela Viorica and Floruța Natalia Mărioara, as labor inspectors, acting in different teams, he allegedly demanded and received, repeatedly, from several businessmen different amounts of money, between 2,000 lei and 4,000 lei.

The respective sums of money would have been claimed and received by the operation in order not to apply contraventional sanctions to businessmen, provided for by the Labor Code, for various detected irregularities, including for “undeclared work”.
On June 13, 2023, the defendant Racz Nadia Florentina would have sent non-public information to some businessmen in the sense that she would have notified them that, on the same day, ITM employees would carry out several inspections in the field of construction .

The file was sent for trial to the Bihor Court.

In this case, the prosecutors benefited from the support of the General Anticorruption Directorate.

Previously, the anti-corruption prosecutors entered into plea agreements with the defendants Buhaș Aurica, Hriscu Daniela Viorica and Floruța Natalia Mărioara, who were charged with committing a crime of bribery, in continuous form.

In the presence of the chosen defenders, the defendants expressly declared that they recognize the commission of the acts held against them, they accepted the legal framework for which the criminal action was initiated and they agreed with the type and amount of the penalties applied, ranging from 1 (one) year and 10 months and 3 (three) years in prison with suspension and the prohibition of certain rights.

We make it clear that this stage of the criminal process represents, according to the Code of Criminal Procedure, the completion of the criminal investigation and the sending of the indictment to the court for trial, a situation that cannot defeat the principle of the presumption of innocence.

SPECIFICATIONS:

Law 190 of 2018, in Article 7, states that journalistic activity is exempt from some provisions of the GDPR Regulation, if a balance is maintained between freedom of expression and the protection of personal data.
