Decision at the Alba Iulia Court of Appeal: A young man who drove drunk and without a license and killed a child, convicted of murder

The Alba Iulia Court of Appeal gave a final sentence in the case of a fatal accident in Petroșani. It is about the tragedy caused by Claudiu Nițariu, a 19-year-old young man, who got behind the wheel drunk and entered a group of 6 young people.

A child was killed as a result of the accident. For his act, Claudiu was charged with murder, attempted murder, driving without a license, driving under the influence of alcoholic beverages and fleeing the scene of the accident.

Already in pre-trial detention at the Aiud Penitentiary, Claudiu found out his sentence: 13 (thirteen) years and 10 (ten) months in prison.

The case shocked the Petroșani community. The young man did not have a license and got behind the wheel drunk. It happened on December 12, 2022. He raced against another driver, drove at 140 kilometers per hour and entered a group of 6 children.

How the accident happened

The file reached the desk of the prosecutors of the Prosecutor’s Office attached to the Hunedoara Court.

“From the investigations carried out in the case, it appears that, on 21.12.2022, around 21:58, without having a driving license and being under the influence of alcoholic beverages, more precisely 1.55 gr.%0 pure alcohol in the blood – the first sample at 23:30, respectively 1.40 gr. %0 pure alcohol in the blood – the second test at 00:30, he drove the VW Passat car (…) on 1 Decembrie 1918 street in the municipality of Petroșani, Hunedoara county, and by not complying with several traffic rules, but also by assuming the production of a road event with fatal consequences for him and other traffic participants, surprised and injured the minor injured persons CRC, USA, GMA, PDI, PLAM and PCA on the pedestrian crossing in the area of ​​the “de la Avion” roundabout, thus determining the death of the latter, on 22.12.2022, but also the bodily injury of the other injured persons, who required days of medical care, after which he left the scene of the accident, without the approval of the police authorities”, noted the prosecutors.

What punishment did he receive?

For his act, at the Hunedoara Court he was sentenced to 13 years and 10 months in prison with execution.

The young man appealed the decision of the magistrates, and the case reached the higher court. In Alba Iulia, at the Court of Appeal, the magistrates upheld the sentence given by the Tribunal.

The young man will have to pay nearly 300,000 euros in moral damages to the parents of the murdered child, but also to the rest of the victims.

The decision was final.
