The decision to dismiss the director from the “George Enescu” National College of Music in Bucharest, Cristina Sebastian, dismissed by the Bucharest School Inspectorate (ISMB) half a year ago, was annulled by the court, according to the judicial portal. The decision can be appealed within the next 10 days, according to the cited source.

In other words, the court took the enforceable decision to annul the decision by which the director of the George Enescu College of Music was dismissed by the School Inspectorate of the Municipality of Bucharest (ISMB) on September 25, 2023, after several ISMB controls at the high school regarding the establishment of a fifth grade.

The school inspectorate decided to replace Sebastian because he had established a 5th grade class without the institution’s approval and had found several irregularities in internal documents, although the high school management requested additional places for students on September 1, after the admission, and received a negative first answer at the high school only on September 19. The 2023-2024 school year began on September 12.

The Education Inspectorate of the Municipality of Bucharest backdated the first decision rejecting the establishment of the class, according to Edupedu.ro sources. The document approved in the meeting of the Board of Directors (CA) of ISMB held on September 12, Tuesday, on the second day of school, is dated September 11, Monday, when no CA meeting would have taken place, according to Edupedu sources. ro. In November, more than 150 teachers and parents of students signed two letters of support for Sebastian. The signatories claimed that the dismissal comes as a measure for the first irregularities found by the School Inspectorate in 13 years of running the high school and that it was an injustice, and the ISMB “did not choose to order measures by which the entire coordination team of the school would be helped and guided ” before making the decision to terminate the management contract for the directors.

Also in November, the School Inspectorate of the Municipality of Bucharest (ISMB) notified the Prosecutor’s Office attached to the Court of Sector 2 in the case of irregularities found in the transfers of students from the beginning of this school year to the “George Enescu” National College of Music, the institution transmitted at that time in – an answer for Edupedu.ro.

ISMB claimed that all the documents it received from the management of the high school, from which the director Cristina Sebastian was dismissed in September, show that “the facts have a criminal character” and were added to the criminal complaint file that the institution open.

Chronology of the Enescu case

The dismissal of director Cristina Sebastian and the controls at the “George Enescu” National College of Music allegedly started from disagreements regarding the difference exams for the admission of 5th grade students and transfers of 5th grade students to integrated vocational education.

Because following these processes carried out at the end of August, 19 applications for admission to the 5th grade were registered, 4 more than could have been accepted for the children’s schooling, according to the high school management, according to the documents obtained by Edupedu.ro, on September 1, the management of the “George Enescu” College of Music sends a request to increase the tuition plan to the School Inspectorate of Sector 1 to which it belongs. Receive the approval and, further, the request reaches the School Inspectorate of the Municipality of Bucharest (ISMB) on September 5.

The first answer comes no earlier than 11th of Septemberat least that’s when the document is dated, when ISMB writes to the high school in an address about the decision, which would be the first, because then there was a change of heart: the “request for supplementing the tuition plan in the school year 2023-2024 with a 5th grade, from two grades to three grades,” he writes in the address obtained by Edupedu.ro.

The non-granting of the supplement would have come after a meeting of the Administrative Council of the Bucharest School Inspectorate on September 11, Monday, the first day of school, the institution claims in the document. In reality, the Board of Directors met to take this decision on Tuesday, September 12, according to Edupedu.ro sources. The document would be then arrived at the college only on September 19during which the high school management started the schooling procedures based on the opinion from the School Inspectorate Sector 1 and without any affirmative or negative answer from the ISMB.

On September 13, on Wednesday, a memo from the high school management reaches the Ministry of Education, more precisely to the state secretary for pre-university education Florian Lixandru. The management of the high school had found out from sources that there is no approval for the class and is asking for support to supplement the number of places to legalize the class with the students admitted after the difference exams and transfers, although since September 11 this class was already functioning.

On 15 September, on Friday, with a service order, three school inspectors appointed by the head of the Bucharest school inspectorate arrive at the Enescu College. The control would have been ordered by the decision of Secretary of State Lixandru, after receiving the memorandum at the Ministry two days ago. The declared purpose of the trip was to check the study formations in the 5th grade, the situation of student registration and placement and timetables in the 5th grade, according to the documents consulted by Edupedu.ro. On the same day, the management of the high school had to present a note of relations in which it supports its point of view and explains the steps it took for the establishment of the 5th class.

The management of the high school and several parents would have reported the situation at the high school to Minister Ligia Deca in the meantime.

Next week, Wednesday, on September 20, a service order and an address of the ISMB arrive at the high school. According to the documents, the inspectors who came to control five days ago were to present the conclusions of the report and, on the same day, according to the ISMB address, the high school was to organize a board meeting where the conclusions would be presented. The college no longer organizes it because, it claims in an answer to the head of the school inspectorate, it does not meet the necessary quorum. He claims that he could organize it the next day, Thursday, September 21, at the earliest. No response is received.

On September 21Enescu College receives from the School Inspectorate of the Municipality of Bucharest class establishment approvalafter a decision taken by the ISMB Board of Directors a day ago, after an address from the Ministry of Education had reached ISMB and had been issued by the Secretary of State Sorin Ion, the consulted documents also show.

On September 22, on Friday, another control of the School Inspectorate comes to the “George Enescu” College of Music. On the same day, the management of the high school sends a memorandum to the minister Ligia Deca in which they claim abuse and inappropriate behavior on the part of the inspectors who came to check on September 15, a week ago.

Monday and Tuesday, on September 25 and 26, ISMB is in turn controlled by the Control Body of the Minister of Education, who arrives at Enescu high school on Tuesday evening, according to Edupedu.ro sources. Also Monday September 25the ISMB Board of Directors meets and decides the dismissal of director Cristina Sebastian. The new director of the College becomes, by the decision of the general inspector Drinceanu, Monica Timaru, a teacher for over 20 years and head of the Complementary Piano department.

No report of the control body or any conclusion has been publicly presented on this case by the inspectorate or the Ministry of Education. No response came to Edupedu.ro’s requests on this case. When received, we will publish it.
