A man from Șelimbăr claims that he is the victim of abuse by the Evangelical Parish in Sibiu after he was evicted from the space he had renovated to turn into a grocery store. The reason for the eviction is that the contractual deadline for opening the business was exceeded by several days. Now, the young man wants to recoup the money he invested in the space.

A young man wanted to open a grocery store, on Mihai Viteazul street in Șelimbăr commune. So, he decided to rent a space from the Evangelical Parish. In order to turn it into a grocery store, that space needed a major investment of around 8,000 euros.

Adrian Albu is the young man who wanted to open a grocery store in a space he rented from the Evangelical Parish of Sibiu, but he would have only been left with the money invested in a place he didn’t use at all. “He made a contract on September 1 last year, but I received the contract on September 15. I had to do renovations. From what I understood from them, in the first phase we were going to rent it for 6 months, after which the contract would be extended for a longer period. On September 25, a lady from the Parish called me to tell me that if I don’t open the grocery store by the end of September, I should go and hand over the key. I told him that I had no way to open because I only took the space two weeks ago and I didn’t have time to get the permits. In that space I was going to make a shop, a kind of grocery store. I told him it was impossible to open in two weeks. We had to lay tiles, tiling, plus the bathroom and permits. Then they said to extend for another month that there is no problem. On October 2, I went to extend the contract for another month. I requested all the necessary authorizations from September. From November 1, he told me to bring the key so I could leave. I said good, but what do I do that I have invested so much money”, said Adrian Albu.

“It’s an abusive contract, with abusive clauses”

The contractor says it was a contract with abusive clauses. The young man wants to recover the money invested in the space where he wanted to open the grocery store, but he was told to return the key. He was also reminded that everything he did is considered abandonment and if he takes anything from that space it will be considered an act of vandalism.

“He told me to take the key to him and that everything I did was considered abandonment and if you took anything from there it was considered vandalism and that was it. I said I would give up the lost time and permit, but I told him I needed the money for the work I did there. I made a bathroom, installed a ceiling light. There was nothing there, just four walls. He told me that I will never get anything. I have not benefited even one day or one hour from the work done and they don’t want to give me anything that I did because I signed a contract that stipulated that within a certain period I would let go of the grocery store. All this time I paid rent. It is an abusive contract, with abusive clauses. I need the money on the bills, what I worked for there”, said Adrian Albu.

Adrian says the Evangelical Parish took him to court to evict the space and pay double the rent. According to a decision in court, the request requiring the payment of rent in the amount of almost 5,000 lei was rejected and the request requiring the tenant to pay the late payment penalty of 0.5% of the outstanding sum was rejected. The young entrepreneur emphasizes the fact that he wants to be paid for the work done on the space, from which he did not benefit at all.

The Evangelical Parish, which rented the space to Adrian Albu, did not comment on the subject. “This situation is not of public interest. It has already been decided by the courts and they will not comment,” said a representative of the Evangelical Parish.
