Recent activities to combat forestry crimes undertaken and made public by IPJ Vrancea

Details about these activities were made public through press bulletin no. 128 of March 28, 2024 edited by the public relations section of the Vrancea County Police Inspectorate (IPJ)

On Wednesday March 27, between 06:00 and 16:00, the policemen of Section 3 of the Vidra Rural Police, with the support of forestry specialists from the Focșani Forest Guard, INCS Marin Drăcea – Vidra Experimental Base, Ocoalelor Silvice Focșani, Zăbala Nereju and Unirea Nereju, have operated in the communes of Vidra, Valea Sării, Năruja, Nistorești, Paltin, Spulber and Nereju, to ensure an appropriate climate of order and public safety, compliance with legal provisions in the field of circulation, storage and processing of wood materials.

The mixed teams carried out 19 checks, of which 10 on public roads and 9 at warehouses/wood processing facilities.

10 vehicles transporting wood were checked in traffic, checks being carried out at 7 specialized companies.

For the detected irregularities, 17 contraventional sanctions were applied, of which 16 according to Law 171/2010 on the establishment and sanctioning of forestry contraventions, in the amount of approximately 36,000 lei.

At the same time, the amount of more than 152 cubic meters of wooden material, with a total value of more than 72,000 lei, was confiscated.

Legal aspects:

The rules regarding the origin, circulation and commercialization of wooden materials, the regime of storage spaces for wooden materials and round wood processing facilities are regulated in HG no. 497/2020 and sanctioned by Law no. 171/2010, regarding the establishment and sanctioning of forestry contraventions.

The dispatch, reception, storage, possession and processing of wood materials by the owners of warehouses, wood processing facilities without legal provenance are sanctioned according to art. 19 paragraph 1 of Law no. 171/2010, with a fine from 1,000 lei, up to 50,000 lei and the complementary measure of the confiscation of the volume of wood material for which the legal provenance cannot be established.

Also, according to the provisions of art. 19 paragraph 2 letter a) of Law no. 171/2010, the transport by any means of transport of wooden materials, with a volume between 0.1 mc and 10 mc, unaccompanied by specific transport documents, is sanctioned with a fine between 1,000 lei and 6,000 lei.

For the transport of wooden materials in volume over 10 mc, unaccompanied by specific transport documents, the act constitutes a crime according to art. 68 paragraph 2 ind. 1 of Law no. 46/2008 – Forestry Code and is punishable by imprisonment from 6 months to a year and confiscation of the wood materials that are the subject of the transport.

For operators who do not have wood materials in warehouses according to the written stocks, registered in the SUMAL 2.0 application, contraventional sanctions may be applied according to art. 19 paragraph 2 letter e) of Law no. 171/2010 in the amount from 1,000 lei up to 50,000 lei, depending on the volume of unowned wood material.
