Apartment living involves sanctions for those who do not follow the rules of living together. This may also apply to the homeowner’s association. A good example can be found in Miercurrea Ciuc, where an association of owners was fined on Tuesday.

On Tuesday, an association of owners from Miercurea Ciuc was fined for exposing the personal data of a rental. The woman notified the National Supervisory Authority for the Processing of Personal Data about the appearance of their names and home addresses illegally on the association’s WhatsApp group. Following the GDPR violation, the association received a fine of almost 2,500 lei.

The investigation was initiated as a result of a complaint, which indicated that the owners’ association disclosed the data of an individual by posting a notification on the WhatsApp group. Through this notification, the plaintiff requests from the operator a series of information and documents related to the operation of the Association.

What illegalities did the authorities find?

“During the launched investigation, it was found that the operator illegally and excessively disclosed the petitioner’s data by posting on the Association’s members’ WhatsApp group a notification sent by him to the Association (name, surname and home address in Bucharest), contrary to art. 5 para. (1) lit. a), c), para. (2) and of art. 6 of the GDPR. It was also found that the Owners’ Association did not present evidence regarding the communication of a response to the petitioner’s request through which it exercised its rights of access, deletion and opposition, thus violating the provisions of art. 12 para. (3) and (4) of the aforementioned normative act”, transmitted ANSPDCP.

In addition, according to the National Supervisory Authority for the Processing of Personal Data, it was observed that the representatives of the association did not provide evidence regarding the implementation of the corrective measures established in the previous finding/sanctioning report. This constitutes a violation of a provision of the National Supervisory Authority, representing a contravention under Article 83 paragraph (5) letter e) of the General Data Protection Regulation. As a result of the identified irregularities, the owners’ association was fined 2,486.2 lei, the equivalent of 500 euros.

Apartment life involves strict rules

Strict rules regarding apartment living also apply to tenants. Law 61/1991 sanctions acts that violate the norms of social coexistence, order and public peace. Fines are applied for disturbing, without right, the peace of the inhabitants by making noise with any device or object or by shouting or shouting.

Also, the law sanctions disturbing the peace between the hours of 22:00-8:00 and 13:00-14:00 by making noise with any device, object or musical instrument at high intensity.

Noisy parties, of a private nature, and the use of musical equipment at an intensity likely to disturb the tranquility of the inhabitants, organized in tents, other facilities or in uncovered space, near homes, are prohibited.
