Only last month, in Iasi, more than 100 employers were sanctioned for non-compliance with the law, the total amount of fines applied by ITM inspectors being 472,000 lei. The most serious misconduct was related to the delay in concluding individual employment contracts.
ITM Iasi inspectors discovered, in more than 100 companies, irregularities of almost half a million lei. All this, in just four weeks, when employees of the Territorial Labor Inspectorate carried out 350 checks, after which they ordered around 200 measures and applied more than 50 fines. The areas taken into consideration were labor relations and occupational safety and health (OSH).
Controls after notifications
Thus, according to a balance sheet of ITM Iaşi, made available to ZdI, in the field of labor relations there were 185 controls, and 47 employers were sanctioned. The most frequent violations were related to: accepting people to work without concluding in written form the individual employment contracts, at the latest the day before the start of the activity; non-compliance with the legal provisions regarding working time and rest time; non-compliance with the legal provisions regarding the payment of due salary rights for the work performed; lack of copies of individual employment contracts for employees at the checked workplace; failure to prepare job descriptions with job duties and failure to issue seniority certificates upon termination of the employment relationship.
Consequently, ITM inspectors applied 36 contravention fines, which are close to 400,000 lei, the most serious violation found here being the acceptance to work without concluding in written form the individual employment contracts, at the latest on the day before the start of the activity, being ordered measures to remedy the deficiencies, respectively the conclusion of the CIM in written form. “The controls carried out were carried out as a result of the notifications registered, of the national campaigns initiated by the Labor Inspectorate during this period, of the planned substantive controls, in the field of competence”, as specified by the ITM Iasi representatives.
ITM Iasi: Over 80,000 lei in fines in the field of OSH
Regarding the field of safety and health at work, in Iasi, 164 employers were checked, of which 64 were sanctioned. Here, most of the deficiencies found were related to the following aspects: the inspection channel within the car repair workshop, where there was a risk of workers falling into the void, was not provided with movable walkways; the own OSH instructions, drawn up by the employer, did not contain measures regarding the suspension and insurance against the movement of motor vehicles during repairs; the access path to the place where the thermal plant was located and the access path to the place where the electrical panel was located, were not free, there were different materials stored; no assessment of dangerous substances and the list of dangerous substances was not submitted to the ITM for recording; work equipment for which the ISCIR checks have not been updated; improper operation of the electricity supply installation, missing PRAM bulletins; lack of periodic medical check-ups or expired skill sheets; blocking access to electrical distribution panels; lack of risk assessment for workers’ occupational health and safety; non-compliance with the own occupational health and safety instructions regarding the storage of flammable substances; not all occupational health and safety signs were provided, in accordance with the provisions of HG 971/2006, at all workplaces; periodic checks of work equipment were not carried out by competent persons; workers did not use personal protective equipment.
Other fines
“The theme of controls in the field of safety and health at work concerned both the verification of the authorization of employers who carry out activities of manufacturing, storage, preservation, transport and sale of pyrotechnic articles; verification of the field “Maintenance and repair of motor vehicles – CAEN code 452”; verification of the field “Manufacture of paints, varnishes, printing ink and mastics” as well as verification of compliance with the minimum requirements for safety and health at work in temporary or mobile construction sites”, the ITM Iaşi inspectors also stated. In this area, they applied 17 fines, totaling 82,000 lei and ordered 195 compliance measures, according to ITM Iasi.
