The local elected officials approved, in the last ordinary edition documented by urban planning, the Zonal Urban Plan (PUZ) and Local Urban Planning Regulation (RLU) for the investment objective: “Zone with mixed functions – building collective housing in height regime 2S+P+6E+ PH and complementary functions, creation of accesses and fencing, placement of advertising elements and site organization” inner city of the Municipality of Arad, neighborhood Confecții, str. Nicolae Oncu, no. 17 Arad county on the plot identified by CF no. 306880-Arad, owner/developer: SC Atlantic House Construct SRL, general designer: SC Pro Arhitectura SRL Although the local municipal councilors of the USR abstained from voting on this draft decision, the documentation related to the investment was approved thanks to the vote of all the others elected .

Therefore, two new constructions, taller than those in the immediate vicinity, will appear on a plot of 6,684 square meters that currently has the use category “yards-buildings”. The new buildings will have the shape of the letter “L”, the longer side being occupied by 2S+P+6E+PH blocks, while the construction of 2S+P+4E+PH blocks is foreseen on the shorter side.

“The land was previously the object of the Decision of the Local Council of the Municipality of Arad no. 39 of 28.02.2011 for the approval of PUZ and RLU , str. Nicolae Oncu, No. 17, beneficiary SC Immobiliare Bassano SRL, project no. 1/2010, elaborated by SC Linia SRL and modified by the Decision of the Local Council of the Municipality of Arad no. 117/2011, in the sense of changing the height regime from P+4E+M to P+6E+PH. The validity of the PUZ approved by the Decision of the Local Council of the Municipality of Arad Arad no. 39/28.02.2011 expires on 28.02.2014, no investment being started based on the approved urban planning documentation” – the decision adopted by the CLM states.

Appeal rejected

Of course, the increase in the height regime displeased the neighbors, who contested the number of floors provided by the designer. The investor did not give in, but was intimidated, invoking (in the correspondence during the first stages provided for in the procedure) the following legal provisions:

“The construction authorization is done with respect to the average height of the neighboring buildings and the character of the area, without the difference in height exceeding the immediately neighboring buildings by more than two levels. Immediately neighboring buildings are those located next to each other, on the same side of the street.” Consequently, “the height regime proposed by us – concludes the investor – exceeds the character of the area by only two levels, i.e. from P+4E+M (5 levels above the ground floor) it will reach 2S+P+6E+PH (7 levels above the ground floor ).”

Access and withdrawals

According to the documentation, “the road service of the PUZ generator plot will be carried out from the North, representing the main access to the regulated complex through the existing Nicolae Oncu street, being completed with a precinct road (the continuation of Rodnei street) with the proposed public legal regime providing a connection with the street Nicolae Oncu and Streiului street. The access to the premises proposed for regulation will have a setback of 7.00 m. A secondary access is also proposed also from Nicolae Oncu Street in the western extremity of the plot proposed for regulation with a setback of 7.00 m.”

Regarding the setbacks from the property boundaries, things are as follows: *in relation to the Nordic property boundary, from Nicolae Oncu street, respectively from which the main access to the studied premises is made, a minimum setback is proposed in accordance with the provisions of HGR 525/1996 and the Civil Code, but not less than 2.20 m; *in relation to the Southern property limit, a minimum setback is proposed in accordance with the provisions of HGR 525/1996 and the Civil Code, but not less than 2.20 m; *in relation to the Eastern property limit – the extension of Rodnei Street, respectively from which the secondary access to the premises is made, an alignment regime is proposed at 2.00 m from the property limit to the street, and respecting the withdrawals of the upper levels, in accordance with the provisions of HGR 525/1996, as the case may be; *compared to the Western property limit, a minimum setback is proposed in accordance with the provisions of HGR 525/1996 and the Civil Code, but not less than 7.00 m.

“If the aforementioned setbacks are less than half the height of the proposed and neighboring buildings, a corresponding setback of half their height, compared to the side/rear limits, respectively at least equal to the height of the proposed constructions and those located facing each other along the existing street and the proposed street extension, measured between the perimeter of the buildings” – the documentation states.

Green spaces

“The building permit will contain the obligation to maintain or create green and planted spaces, depending on the purpose and capacity of the buildings. Green and planted spaces will be provided, with a decorative, protective and recreational role outside the buildings – at least 25% for the function of collective housing, taking into account the provisions of HCLM Arad 572/2022 regarding the approval of the Regulation for ensuring the minimum area of ​​green spaces for construction and development works authorized within the radius of the municipality of Arad. In the context of the abolition of the green space area from the proposed right of access, according to art. 6, of Law 24 / 2007, the integrity and restoration of the affected green space will be ensured, in its immediate vicinity, in order not to reduce the area inventoried as green space at the level the municipality of Arad” – it is stated in the documentation.

180 parking spaces

According to the designer, “only those constructions will be authorized that will have secured parking spaces inside the proposed regulatory premises. Parking of vehicles on green spaces is prohibited. For the dominant function of the plot, mixed sub-zone of collective housing and services, commerce, administrative offices, parking spaces will be created, taking into account the provisions of Annex no. 5 of Decision no. 525/1996 on the approval of the General Urban Planning Regulation, republished, with subsequent amendments and additions. According to the attached documentation, min. 1.5 parking spaces for each housing unit in the regulated area. The number of parking spaces expected: 150 for residential units, and for services and commerce approx. 30 customer, personal parking spaces, of which at least 1 supply parking space (maximum tonnage 3.5 t), resulting in a total of approx. 180 parking spaces arranged on the ground, on the ground floor and in the basement of the building”.
