The tender for the second section of the metropolitan belt of Cluj was canceled as the bid submitted was 30% higher than the value estimated by the authorities, according to the explanation provided by the mayor Emil Boc.

According to the explanation provided by the mayor of Cluj, Emil Boc, in the extraordinary meeting of the local council on Monday, the only offer that was submitted for the construction of section 2 of the metropolitan belt had values ​​higher than those estimated for this project.

Boc: “Legal, I had no other solution”

At the same time, the association led by Con-A Operations has 10 days to contest the decision of the Cluj authorities.

“The sole bidder could not proceed because the bid is non-compliant and was declared inadmissible.

It got here because any offer must fall within the estimated value. The law makes it possible, exceptionally, for the maximum value to be increased by 15%. This, if all bidders have exceeded the value by a maximum of 15%”, explained mayor Emil Boc.

The value of the metropolitan belt project has already been increased, precisely to allow the continuation of the bidding procedures. The National Public Procurement Agency did not approve the 30% cost increase of the metropolitan belt project.

“The city hall legally had no other solution. We have analyzed in detail and we cannot ignore the opinion of the National Public Procurement Agency. That’s why I declared this offer non-compliant”, explained mayor Emil Boc.

According to the legal procedure, the CON-A Operations Association, Dimex 2000, Concelex, Hydrostroy and Automagistral Pivden can file an appeal at the National Council for the Resolution of Appeals within 10 calendar days from the communication of the result procedure (until May 9, 2024). If no appeal is filed or the appeal is rejected, the bidding procedure is resumed immediately.

In case of The National Council for the Resolution of Appeals wins the Association’s case CON-A Operations, Dimex 2000, Concelex, Hydrostroy and Automagistral Pivden, then you can proceed to the conclusion of the contract and at the start of the works.

The Cluj metropolitan belt project was tendered in two stages. The total value of the investment reaches 8.6 billion lei including VAT. Phase 1 will involve costs of 6.1 billion lei, and Phase II – 2.5 billion lei. The execution duration of the works for each phase of the project is 4 years, and the total term of the works is estimated at 8 years.
