The Superior Council of the Magistracy notified the Judicial Inspection to launch an investigation in the case of a judge from Iași, who postponed dozens of cases using at least an unusual reason. According to the local media, Iuliana Garabet from the Iași Court postponed for half a year all the cases she had to judge in one day citing the Universal Declaration of Human Rights proclaimed in 1948 as a reason.

“Under the provisions of art. 45 of Law no. 305/2022 regarding the Superior Council of the Magistracy, republished, with subsequent amendments and additions, the President of the Superior Council of the Magistracy decided to notify the Judicial Inspection in order to carry out checks, according to the legal powers, regarding the existence of indications of possible disciplinary violations by a judge from the Iasi Court.

The notification is based on the issues that appeared in the mass media during the days of April 24, 25 and 26, 2024, regarding unworthy attitudes during the service towards lawyers and litigants, as well as possible situations of non-compliance, repeatedly and for imputable reasons, of the legal provisions regarding the speedy resolution of cases or the repeated delay in carrying out the works, for imputable reasons”, announced the CSM on Friday, in a press release.

The Dezvăluirea publication reported that, on April 15, judge Iuliana Garabet from the Iași Court postponed for half a year all the 44 files she had on the list of the meeting of that day, citing an at least bizarre reason: she did reference to the Universal Declaration of Human Rights.

“Considering the standard of transparency established by the Universal Declaration of Human Rights proclaimed by the General Assembly of the United Nations on 10.12.1948, the European Convention on Human Rights, the margin of appreciation recognized by the states, the court assesses the case in a state of adjournment and grants a trial term to date of 30.09.2024, 09:00, for when the parties are summoned with the mention of formulating clarifications regarding the invoked documents, under the penalty of canceling the request, by reference to art. 12 of the Civil Procedure Code”, reasoned judge Iuliana Garabet, according to the cited source.

The publication Dezvăluirea also states that this was not the only meeting in which Iuliana Garabet postponed the files without a good reason and that none of the parties had ever requested the postponement. In addition, none of the parties in the files requested a deadline for the preparation of the defense, all postponements were made by its decision and not at the request of the litigants.
