The European Commission is investigating a contract regarding the design, construction and operation of a photovoltaic park in Romania

The European Commission has launched two investigations into allegations of foreign subsidization in a public procurement procedure in Romania. The Romanian contracting authority in question is Societatea PARC Fotovoltaic Rovinari Est SA, which launched a procedure for the construction of a photovoltaic park in Romania, partially financed by the EU Fund for modernization.

The investigations were initiated following notifications received from the Enevo Group, including LONGi Solar Technologie GmbH, and Shanghai Electric UK Co. Ltd. and Shanghai Electric Hong Kong International Engineering Co. Ltd.

The European Commission will examine in depth the alleged foreign subsidies granted to bidders and will assess whether they led to the presentation of unreasonably advantageous offers in the public procurement procedure. The Foreign Subsidies Regulation states that companies are required to notify their public procurement tenders in the EU when the estimated value of the contract exceeds €250 million and when they have been awarded foreign financial contributions of at least €4 million from at least a third country in the three years preceding the notification.

The first consortium under investigation consists of the Enevo Group and LONGi Solar Technologie GmbH, and the second consists of Shanghai Electric UK Co. Ltd. and Shanghai Electric Hong Kong International Engineering Co. Ltd.

The company PARC Fotovoltaic Rovinari Est SA launched the tender for the construction of four photovoltaic parks with a total capacity of 450 MW. The tender attracted eight bids, including those from Enevo Group in association with LONGi Solar Technologie and Shanghai Electric Hong Kong International Engineering Company Limited in association with Shanghai Electric UK Company Limited.

The European Commissioner for the Internal Market, Thierry Breton, emphasized the importance of the investigations to maintain the economic security and competitiveness of Europe.
