The updated salary list from the Constitutional Court shows that judges’ incomes have increased since the last report, at the end of September. 63,647 lei is the updated gross income of the president of CCR, Marian Enache. And this amount is composed of a monthly gross allowance of 47,074 lei, to which is added 11,769 lei (increase for risk and neuropsychic overload), 2,354 lei the increase for preserving confidentiality, 1,500 lei increase for harmful conditions (amount capped according to the budget austerity law, given that according to the data of the previous salary, the increase reached 7,061 lei), and 950 lei for the fact that he has a doctorate.

Instead, at the end of September, the gross profit was 62,145 lei, and on March 31, 2023 it was 42,122 lei, according to the data available on the CCR website. According to Marian Enache’s last wealth declaration, from June 2023 (in which the income from the fiscal year 2022 is presented), his salary was 374,725 lei, which means a monthly average of 31,227 lei, cash in hand. Moreover, Enache is also a beneficiary of a special pension, and the last amount mentioned in the declaration of wealth is 438,965 lei in fiscal year 2022, which means an average of 36,580 lei.

According to the Salary Law, “the president of the Constitutional Court is equal in rank to the president of the High Court of Cassation and Justice, and the judges of the Constitutional Court, with the vice-president of the High Court of Cassation and Justice, benefiting from an allowance equal to theirs at the maximum level, not conditioned by seniority the position of judge or prosecutor, as well as the others”.

Gradual increases

As for a simple judge from the CCR, like the other eight, the salary on March 31, 2024 reaches 61,288 gross lei. As in the case of the head of the CCR, in addition to the gross monthly allowance, there are several increases that bring the constitutional magistrate’s salary to an amount exceeding 60,000 lei. Compared to September 2023 and March 2023, the amount is higher, given that the (gross) salaries at that time were 59,792 lei and 41,402 lei, respectively.

Some judges, who meet the necessary conditions to be entitled to a (special) service pension, also receive this second income. What is the case of Cristian Deliorga (appointed in 2019), who received, according to the last wealth declaration (June 2023), a total pension of 377,304 lei in 2022, which means a monthly average of 31,442 lei. In the case of these revenues, it is the net amount. A veteran from the CCR, i.e. Livia Stanciu (former head of the ÎCCJ), had total pension receipts and salary differences of 461,880 lei (monthly average of 38,490 lei).

The conditions for the right to a special pension

Unlike other socio-professional categories, with a considerable number of years of activity and the need to reach a certain age, in the case of pensioners from the CCR, the conditions are much more relaxed. “Judges of the Constitutional Court with at least 25 years of experience in legal activity or in higher legal education, regardless of age and retirement date, benefit, upon request, from a service pension equal to 80% of the calculation base represented by the allowance of gross monthly employment and the increments received. For each year that exceeds the mentioned seniority, 1% of the calculation base is added to the pension amount, without being able to exceed it. The pension established in this way is updated in relation to the employment allowance”, the Law on the organization and operation of the CCR provides.
