The Ministry of Education has come up with important clarifications regarding the political activities present in schools in Romania or in competitions. The Ministry sent a note to all County School Inspectorates.

Political activities, prohibited in schools in Romania

The Ministry of Education reminded that any political activity in schools is prohibited.

In a note sent to the County School Inspectorates, principals and teachers were informed that it does not matter whether they take place during or outside of class. By outside it is meant at contests or sports or artistic competitions, organized by political formations.

These provisions are found in the Education Law.

The note sent to the county school inspectorates comes in the context where, this year, there will be four types of electoral elections.

“Political demonstrations and propaganda and religious proselytism are prohibited in educational institutions”, reminds the Ministry of Education in a note sent to school inspectorates in the territory.

Penalties for those who do not comply with the law

The note emphasizes that violation of these rules is considered a disciplinary offense and will be punished in accordance with the law.

Education Law no. 198/2023 prohibits discrimination in educational institutions and online activities, according to the criteria established in Government Ordinance no. 137/2000 on the prevention and sanctioning of discrimination. Political demonstrations and religious propaganda are also prohibited.

The disciplinary sanctions that can be applied to the teaching staff are the following, depending on the seriousness of the violations:

a) Written warning

b) Reduction of the basic salary, including the management, guidance and control allowance, by up to 15%, for a period of 1-6 months

c) Suspension of the right to enroll in a competition to obtain a merit grade, to occupy a management, guidance and control position or a higher teaching position, for a period of up to 3 years

d) Suspension of the right to be part of the commissions for organizing and conducting national exams. The suspension is for a period of up to 3 years

e) Disciplinary cancellation of the individual employment contract

For the disciplinary offenses specified in article 209 paragraphs (2) letters a) and b), the sanctions listed in paragraph (1) letters b)-d) may be applied cumulatively or the sanction mentioned in paragraph (1) letter e). For the other violations, the sanction referred to in paragraph (1) letter e) or one or more of the sanctions listed in paragraph (1) may be applied.

In relation to the seriousness of the disciplinary offense, when applying the sanctions mentioned in letters b)-e), it is possible to opt for the withdrawal of decorations, orders, medals and titles awarded to teaching staff, in accordance with the provisions of article 218, writes edupedu.ro.
