Theatrical stunt. On April 19, the DIICOT prosecutors sent the Veranda batch to court and, on the same day, the four incriminated senior officials immediately went on leave. The procedure is completely illegal: prosecution is tantamount to legal suspension.

In the disposition drawn up by the Human Resources Service, with the suspension of Cristina Oțeleanu on April 19, mayor Mihai Chirica crossed out the date with a pen and noted: “Att. to the indictment communication”. Below, at the signature, he specified: “Date of communication of the indictment 22.04.2024, 13:50”.

Chirica’s abuse is incredible: he decided, on his own, the date of the suspension. Information obtained by REPORTER FROM IAŞI are contradictory: authorized sources claimed that the stake was for the four to take their money on leave, other officials stated that, however, the payments would not have been made.

Even more serious: in the electronic system for recording documents from the City Hall related to April 19, an address appeared as sent from Cristina Oțeleanu, former head of the Legal Department, to the Iași Court, criminal section, in the Flux File, in who is being judged the mayor. But Oțeleanu was legally suspended on the 19th, at the time she was corresponding with the court in another corruption case.

Cristina Oțeleanu drew up official documents after the suspension

On April 19, Friday at 11:06 a.m., REPORTER FROM IAŞI received the information that high-ranking officials led by the mayor Mihai Chirica were sent to court in the Veranda case. The news was immediately confirmed, as the file was registered on the court portal at that time. In parallel, in the City Hall, the electronic document circuit recorded that at 11:07 a.m., Cristina Oțeleanu, head of the Legal Department, received an address from the Iași Court in file 4050/99/2022 to which, as shown by the data from system, would have responded the same day. This number corresponds to the Flux file, the request had come to the City Hall the day before.

At the last deadline in this file, on April 4, the court postponed the case, one of the reasons being: “To issue addresses to the injured persons with a view to being constituted as civil parties”. Iași City Hall is one of the injured parties in this file and had time to respond until the next scheduled deadline on May 16. Mayor Mihai Chirica is also on trial in this case, the object being “corruption crimes”.
Did Oțeleanu respond to this address? What are its contents if it was shipped? The information is fundamental because, according to legal experts, on April 19, Cristina Oțeleanu was suspended by law, once she was sent to court, and therefore no longer had the capacity to make addresses on behalf of the City Hall.

Chirica changed the suspension date on his own

Timeline:
– On the indictment of the anti-mafia prosecutors, the date of sentencing is April 17
– On April 19 was the court registration
– Article 513 (1) of the Administrative Code provides that the service report is automatically suspended when the civil servant is in one of the following situations: letter l) “in the event that it was ordered to be sent to court for the commission of a crime”
– The Human Resources Service of the City Hall reacted only on April 24 and drew up a provision that it sent to the mayor to sign. Article 1: “The legal suspension, starting from 19.04.2024, of the service report of Mrs. Oțeleanu Cristina Daniela – Executive Director – Legal Department”
– Hallucinatingly, mayor Mihai Chirica crossed out the date of April 19 and wrote above: “att. to the indictment communication”. Below, under his signature, he added: “Date of communication of the indictment 22.04.2024, 13:50”. Basically, Chirica stood up to the legislator and said that the suspension date is not Friday, the 19
– To the right of the mayor’s signature is that of Denisa Ionașcu, the general secretary who, in turn, made an annotation: “Indictment date 17.04.2024”.

The predecessor Georgel Grumeza clarifies the issue of suspension from office

We have, therefore, three interpretations:
1. The Human Resources Service considered that the date of Oțeleanu’s suspension was April 19 when the file was registered in court
2. Denisa Ionașcu estimated April 17 as the date of suspension, the day Oțeleanu was sent to court, as it appears on the first page of the indictment
3. Mayor Mihai Chirica does not consider the date of the 19th correct, which he crossed out with a pen and suggested April 22 as the date when the indictment was communicated
A similar case was also tried in Iași and featured another City Hall employee, Georgel Grumeza, the former head of the Local Police:
– The indictment was issued on October 10, 2022
– The date of notification to the Tribunal (registration at the court) was October 12
– The town hall was notified on October 17, and the suspension started on the 12th, the date of the court registration

Date of suspension, according to the judge: the day the indictment ISSUED”

The judges who analyzed Grumeza’s case stated that the suspension should have occurred from October 10, the date of the indictment. “The court shows that the referral to court took place through the drawn-up indictment, which was issued on 10.10., the respondent (City Hall – no) choosing to order the suspension starting from the date of notification to the Iași Court”.
Another passage, with argumentation:
“In the opinion of the court, the suspension could be ordered as early as 10.10.2022 (the date of the indictment), while in fact the suspension was ordered from 12.10.2022, two days later. (…) The de jure suspension of the service relationship is conceived by the legislator as a measure of protection of the public authority, with the aim of depriving the public official who is suspected of having committed a service offense or in relation to the service from the possibility of to commit in the future acts of the kind for which she is being sued (…)”.

Architect Raluca Mocanu, from Urbanism, lost her position after the Veranda Case. He executed the orders of Mihai Chirica. La Flux refrained at the last moment, saying: “I’m afraid!”

The mayor’s interference is abusive

Returning to the address of the Iași Court that arrived on April 19 at 11:07 a.m. in Oțeleanu and to which it would have responded on the same day, as it appears in the system, the head of the Legal Department was suspended at that time. Because, based on the previous reasoning of the court in the Grumeza case, here Oțeleanu should have been suspended from April 17, the date the indictment was issued.
In the internal electronic system of the City Hall, the address from April 19 appears as resolved “favorably” by Oțeleanu also on April 19 and the second copy was archived on April 26.
Mayor Chirica’s interference is incredible. He removed the suspension date, April 19, from Cristina Oțeleanu’s disposition. The Human Resources Service drew up suspension provisions, also dated April 19 and for
Mihaela Pintilie, lawyer in the City Hall, Raluca Mocanu, senior adviser to the Directorate of Architecture and Urban Planning and Alexandru Mustiață, chief architect.

In their case, for example at the disposition of Mustiață, the mayor no longer crossed out the date of April 19 from the body of the provision, but only made a footnote, to the signature: “Date of communication 22.04.2024, time 13:50”.

Four heavyweights from the City Hall quickly ran away on leave even though they were already suspended

Several internal sources in the City Hall argued for REPORTER FROM IAŞI that, on the same day, April 19, 2024, the four – Oțeleanu, Pintilie, Mocanu and Mustiață – completed their leave requests. All 4 were legally suspended from April 17, the date of the indictment, but their leaves were approved.

A second argument: there is a provision of the mayor from February 2024 according to which applications must be submitted to the secretariat of the Cabinet Mayor in good time: “so that they are approved and registered at least one day before the day for which the leave was requested”.
Conclusion: the furloughs were approved two days after the indictment was issued, on the date of its registration in court when the officials were already legally suspended. Two in hand: the requests were not submitted a day before the leave date. And three: there is conflicting information about the payment of these holidays, with some sources stating that the money has been collected, others that the payments have not been made.

Two more details of this case:
1) Cristina
Oțeleanu still comes to the City Hall every day, he was also yesterday, although he no longer has any official capacity in the institution.
2) The one who signed the suspension provisions of Oțeleanu, Mustiață, Mocanu and Pintilie is Chirica himself, co-accused with them in the case. Chirica, as elected, remained in office, subordinates flew from the City Hall.
In the more than 600 pages of the DIICOT indictment from the Veranda File, the case prosecutor dismantled, step by step, the corruption in Iași City Hall, whose leaders and officials violated the law for years. In this file, Mayor Mihai Chirica is accused of committing three crimes, all related to the illegal authorization of the space on the Central Hall where the Veranda Restaurant operates. Three witnesses in the case reported to the prosecutor that, when he signed, Mihai Chirica knew every time that the works on the building in question did not comply with the authorizations.
