A woman from Iasi, with a pension of no more than 800 lei after almost 36 years of work, went to court to ask for an increase, but was unsuccessful.

The woman’s pension, worth 797 lei, is two and a half times lower than the average pension in Iasi, but also 40% lower than the minimum pension in the country.

However, the court’s decision was that the woman’s pension was calculated correctly.

In 2023, Maria C. sued the Pension House, asking for a decision on her pension to take into account the entire contribution.

The woman showed that she had retired in 2014, after 36 years and 9 months of work, of which 11 years and 5 months in the first group. The calculated pension amounted to 797 lei.

The only period not taken into account and which the woman invoked was five months: two in 1982, two in 1994-1995, when she had been placed in the first group, and one more in 2006, when she had a salary of 1,020 lei.

On the other hand, the representatives of the County Pension House stated that the woman had not contested the retirement decision from 2014, nor three pension review decisions, issued in 2017.

The woman’s pension had been calculated correctly, taking into account all periods of group or hard working conditions.

The explanation is that the two months of 1994 could not be taken into account, because the company had not worked, and the woman had not been paid her social security contributions.

At the trial court, the judges did not find any argument in favor of the woman.

“The appellant did not indicate any element on which she based her statement or any calculation of her own, compared to that of the respondent, by which to demonstrate this aspect, as she did not request the administration of evidence with accounting expertise to demonstrate the alleged error.

Thus, she limited herself to stating that the pension was not calculated correctly and indicated several legal provisions in the matter of calculation”, the judges observed.

The clarifications provided by the Pension House, which presented in detail how the woman’s score was calculated, convinced the judges that the pension was calculated correctly, with the woman deserving only 797 lei per month. The Tribunal’s sentence is subject to appeal, according to ziaruldeiasi.ro.
