The judges at the Craiova Court of Appeal ordered the maintenance of preventive detention against a Dole resident who has been incarcerated since November 2022 for rape and child pornography. Another defendant in this case is being tried under judicial control, and the third was placed under house arrest. According to the investigators, in May 2022, two of the defendants allegedly raped a 15-year-old minor, who was under the influence of alcoholic beverages. The third defendant is accused of republishing and distributing pornographic materials with a 15-year-old minor.
DIICOT prosecutors explained that the victim was raped by two of the defendants.
“In the case, it was noted that, in May 2022, two of the defendants raped a minor injured person, aged 15 at the time of committing the acts, taking advantage of her inability to defend herself and express her will. The act of rape was committed for the purpose of producing pornographic materials, being recorded by the third defendant. The pornographic materials that were later distributed to other people”, stated the investigators.
On November 29, 2022, two of the defendants were remanded in custody. The third defendant was arrested at home. The latter was placed under judicial control in December 2023.
Minor raped after consuming alcohol
In the drawn up indictment, the investigators claimed that the victim was raped after consuming alcohol.
“The defendant BC, on the night of 25/26.05.2022, together with the defendant BI, based on the agreement with him, had sexual intercourse with the injured person, taking advantage of the injured person’s inability to defend himself (he was in a state of unconsciousness/semi-consciousness due to excessive alcohol consumption), for the purpose of producing pornographic material(…). After having sexual relations with the minor injured person, without her consent, the defendant contacted his cousin and informed him about the acts committed against the injured person, at the same time calling him to appear at the scene of the crime to participate and him to acts of sexual abuse”, argued the prosecutors.
The three defendants were referred to justice in December 2022. The file was registered on the roll of the Dolj Court. The court postponed the pronouncement of a sentence for May 21, 2024.
Doljean tried for the rape of a minor, behind bars
On April 1, the Dolj Court ordered the maintenance of preventive detention against the defendants arrested as early as November 2022. The court also ordered that the third defendant in the file remain under judicial control. Later, the Craiova Court of Appeal accepted the appeal filed by one of the arrested men and ordered his placement under house arrest.
Later, on April 23, the Dolj Court placed the last pretrial defendant under house arrest. The court’s decision was contested by DIICOT prosecutors at the Craiova Court of Appeal. On April 30, the court admitted the action of the investigators and ordered the maintenance of preventive detention against the defendant. The decision of the Craiova Court of Appeal is final.
