The state company Hidroelectrica, the largest producer of electricity in Romania and one of the largest contributors to the state budget, sued the Tax Office, contesting a tax decision from last year, by which ANAF imposed an amount on the company additional payment in the amount of over 62 million lei to the surcharge owed by the producers in the sector, plus accessories of 1.56 million lei, reveals the data analyzed by Profit.ro, informs News.ro.
Hidroelectrica paid the required sums in full, after which it administratively contested the tax documents. Since his appeals were rejected, he went to court.
Hidroelectrica accuses a huge overcharging
The company argued, through the summons request, that the successive amendments to the normative acts regarding the methodology for calculating the tax for electricity producers can only be applicable for the future, starting from the date of publication of the amendment to the normative acts and not retroactively, so as the tax authorities considered, Profit.ro indicates.
Hidroelectrica calculated for 2022 a total surcharge of 671.7 million lei, of which over 557 million lei for the production from hydropower plants and 114.6 million lei for that of the Crucea wind farm.
