Popa Eugen, a retired police officer from the Novaci Police, built a one-story villa on Eroilor street in the city, this in the period 2022-2023. The land on which the construction was built was granted to the owner of the house by Novaci City Hall, at the time when Popa Eugen was no longer in office, he was retiring. It is about a 76 square meter plot of land, in the public domain.

It is interesting that the local authority can only grant land for purposes of public interest, and the villa of the former policeman does not fall under the provisions of the law.

At least that’s what the neighbor of the MAI pensioner, lawyer Petricu Marcel Silvius, who submitted a criminal complaint to the Prosecutor’s Office attached to the Novaci Court in April 2023. The neighbor is angry that his access to his agricultural land was suppressed by this construction.

The Novaci Prosecutor’s Office investigated the criminal case for abuse of office for several months, deciding to close the case in November 2023. The lawyer challenged the ordinance at the Novaci Court and the court decided on March 12, 2024 to abolish the ordinance and ordered the case to be sent back to the prosecutor to complete the criminal investigation.

In the case is a file of abuse of office in rem for the deed, i.e. for abuse of office, all the signatories of the concession contract being targeted, i.e. seven employees of the Novaci City Hall.

The plaintiff proved that he has a deed of donation which indicates that he had, for many years, access to the public domain in the area where the new construction was built.

Lawyer Petricu is waiting for the Novaci Prosecutor’s Office to finalize this criminal file by sending the guilty to court.
