ITM ALBA: Fines of 15,000 lei and 22 warnings between March 25 and 29, 2024. What irregularities did the inspectors find

Alba ITM inspectors issued 27 warnings and fines in the amount of 15,000 lei between March 25-29, 2024.

Through the Action Framework Program of ITM Alba for the year 2024, approved by the leadership of the Labor Inspectorate, it was established that one of the priority objectives of the inspectorate’s activity is the fight against undeclared and underdeclared work, in order to discourage and reduce this phenomenon which, in fact, is also a form of tax evasion.

At the present date, at the ITM Alba level, a national campaign is underway, ordered and monitored by the Labor Inspectorate, namely:

1. The national campaign for information and awareness of the provisions of Law 367/2022 on social dialogue, which takes place between 01.02.2024 and 31.12.2024.
2. In the period 25.03.-29.03.2024, the National Campaign regarding the verification of the conclusion and execution of individual employment contracts as well as the observance of occupational health and safety rules by employees in preschool education and daily care activities took place in Alba County. children, CAEN 8510 and 8891.

The daily activity of the labor inspectors aimed, with priority, at sanctioning undeclared and under-declared work, the results of the performed controls being communicated weekly to the Labor Inspectorate.

The results obtained at the level of Alba county, during the period 25.03.- 29.03.2024, in the control activity, are reproduced below.

In the field of labor relations:

Total controlled units: 42
Number of employees of controlled employers: 546
Of which – women: 330
Number of identified deficiencies: 91
No. sanctions applied to employers: – 12 of which:

– 10 Warnings;
– 2 Fines – 15,000 lei;

The main deficiencies found in the controls:

– the record of the time worked is not kept correctly;
– seniority certificates were not issued upon termination of activity;
– individual part-time work contracts do not contain clauses regarding the distribution of the work schedule;
-salaries were not paid, on the date established in the individual employment contracts;
-non-payment of overtime and non-granting of annual legal holidays;
– failure to grant weekly rest and the related increase;
– there is no proof of handing over a copy of the individual employment contract to the employee;
-personal files do not contain the necessary documents for employment;
– collective bargaining was not initiated at the unit level;
-copies of individual employment contracts are not kept at the company’s workplaces;

In the field of safety and health at work:

The main deficiencies established in controls:

-Lack of skill sheets issued following the employment and/or periodical medical examination of workers.
-Lack of assessing the risks of occupational injury and illness for the activities carried out.
-Lack of initial authorization and periodic checks of technical equipment subject to ISCIR regulations.
-Lack of periodic training of workers.
– Inadequate organization of the activity at the unit level, according to the new regulations of GD no. 955/2010 for the modification and completion of the Methodological Norms for the application of the provisions of the Law on Safety and Health at Work no. 319/2006.
-Lack of own work safety instructions for the activities carried out.
-Carrying out the activity without performing the medical examination upon employment and/or periodically of the workers.

On 29.03.2024, at 11.00, ITM Alba organized a meeting with employers from Alba county, with their representatives on the Occupational Health and Safety line, with representatives of the External Prevention and Protection Services, in order to the dissemination of some legislative aspects in the field of Safety and Health at Work and the presentation of the actions that ITM Alba will carry out in this field, during the year 2024.

45 people participated from various employers in Alba County, namely employers, designated workers/internal prevention and protection services and representatives of the External Prevention and Protection Services from the county.

Aspects related to:
– Actions from the Framework Program of ITM Alba, in 2024, approved by the Bucharest Labor Inspectorate
– The Control Methodology in the construction field was presented in detail, a campaign that will take place between April and December 2024

The meeting was attended by a representative of the Institution of the Prefect of Alba County and a representative of the Alba County Pension House – Work Accidents and Occupational Diseases Department.
