Mario Iorgulescu, who fled to Italy, introduced through his lawyers, at the High Court of Cassation and Justice, an extraordinary way of appeal – the cassation appeal. In this way, he tries to escape the sentence of 13 years and 8 months of imprisonment received for murder and driving a vehicle under the influence of alcohol and drugs (cocaine), in connection with the car accident caused in 2019, resulting in the death of a man.

On Thursday, in the courtroom, Iorgulescu’s lawyer argued that the young man cannot participate in the trial, because he has brain injuries since childhood, as shown by an investigation carried out in Italy with a high-performance medical device.

“It is an aspect proven even before the court of appeal. It is a high-performance medical device, which unfortunately revealed these irreversible ailments that he suffers from and played a role (in causing the accident – no). He is unable to effectively participate in a criminal trial, because he does not understand what is happening”, said the lawyer upon leaving the courtroom.

Also, the defenders requested the change of legal classification, arguing that Mario Iorgulescu should not have been tried for committing the crime of murder in connection with the occurrence of a road accident.

The supreme court postponed for April 11 the pronouncement of a decision in the cassation appeal filed by the defense of Mario Iorgulescu.

How the fatal accident occurred

In the evening of September 7, 2019, Mario Iorgulescu went to a party in a town near Bucharest. The witnesses interviewed by the prosecutors stated that, around 3:00 a.m., after arguing with his ex-girlfriend, Iorgulescu jr got behind the wheel and left for the Capital. He was driving a car received as a gift from his father, worth 300,000 euros.

At the entrance to Bucharest, with 143 km/h, as established by the investigators, Mario Iorgulescu entered the opposite direction and hit another car head-on. It was led by Daniel Vicol, who died on the spot. Two children were then fatherless.

Mario Iorgulescu had a blood alcohol level of 1.96 g/l and, according to the indictment, in the biological samples collected from him, the following were detected: “cocaine and metabolite; diclofenac (metabolites); fentanyl”.

After causing the accident, Mario Iorgulescu, being injured, was admitted to the Elias Hospital and then transferred by his family to Italy.
