Four traffic inspectors and the deputy mayor of Sârbi commune in Bihor county were sent to court by DNA Cluj prosecutors in a case regarding the protection provided to some transport companies.

Four traffic inspectors and the deputy mayor of Sârbi commune in Bihor county were sent to court by DNA Cluj prosecutors in a case regarding the protection provided to some transport companies, and two other people concluded recognition agreements with anti-corruption prosecutors.

According to a press release issued on Monday by the DNA, the defendants Ioan Orha – road traffic inspector within the Maramureş Territorial Inspectorate, Sorin Gelu Baicu – road traffic inspector within the Bihor Territorial Inspectorate, Cristin Viorel Ţepele were referred to justice, under judicial control – road traffic inspector within the Bihor Territorial Inspectorate, Florin Mihai Zehan – road traffic inspector within the Cluj Territorial Inspectorate, investigated for abuse of office (in the case of the defendants Orha, Baicu and Zehan), use, in any way, directly or indirectly , of information that is not intended for publicity or allowing unauthorized persons access to this information, in order to obtain money, goods or other improper benefits for oneself or for another, in a continuous form, taking bribes in a continuous form (in the case of the defendants Orha and Tepele).

Deputy mayor, sent to court for complicity in bribery

Also, Florin Mădălin Popovici, deputy mayor of Sârbi commune, was sent to court for complicity in bribery and carrying out financial operations, as commercial acts, incompatible with the function, attribution or assignment that a person fulfills, in order to obtaining money, goods or other undue benefits for oneself or for another.

“In this case, investigations were carried out regarding the manner in which, in the period 2021-2023, traffic inspectors from the ISCTR – Territorial Inspectorate 4, including the defendants mentioned above, would have ‘protected’ several commercial companies with an object of activity in the field of road transport, in that it would have provided their administrators with information not intended for publicity regarding the controls that were to be carried out and would not have taken the legal measures to sanction them with regard to the violations of the law that they would have found (exceeding the maximum authorized transport mass, lack of transport license, etc.)”, says DNA.

The prosecutors say that the defendants Orha Ioan and Ţepele Cristin Viorel, directly or through intermediaries (for example the defendant Popovici Florin Mădălin), would have received sums of money from the representatives of some transport operators (up to 20,000 lei, in the case of the defendant Ţepele Cristin Viorel) or other improper benefits.

Between April 2022 and August 2023, Popovici Florin Mădălin, as deputy mayor of Sârbi commune, would have in fact administered a commercial company active in the field of road transport and would have carried out several commercial operations, as commercial acts incompatible with the function , say the investigators.

In the case, protective measures were ordered. The file was sent for trial to the Cluj Court, with a proposal to maintain the preventive and insurance measures ordered in the case.

In the case, the prosecutors benefited from the support of the General Anticorruption Directorate. Also, the DNA prosecutors concluded plea agreements with the defendants Mircea Mihai Pop and Vasile Şofron, road traffic inspectors within the Cluj Territorial Inspectorate, for committing the crimes of abuse of office (Pop’s case) and using, in any way , directly or indirectly, of information that is not intended for publicity or allowing unauthorized persons access to this information, in order to obtain money, goods or other improper benefits for oneself or for another, in a continuous form (in both cases).

In the presence of the chosen defenders, the two defendants expressly declared that they recognize the commission of the acts held against them, accept the legal framework for which the criminal action was initiated and agree with the type and amount of the penalties applied, as well as with the form of execution of the to them, respectively one year in prison with the suspension under supervision of the execution of the sentence for a period of two years of supervision and the prohibition of certain rights (in the case of the defendant Pop Mircea Mihai); one year and two months in prison with the suspension under supervision of the execution of the sentence for a period of two years of supervision (in the case of the defendant Şofron Vasile).
