The Oradea Court of Appeal fined the head of the Marghita hospital’s pharmacy, Balogh Eva, accused of defrauding the CAS budget through her own home care company, settling thousands of medical services that, in reality, she did not provide never. The woman is obliged to return the collected money, but also penalties, in total being more than 75,000 euros.

The patron with diapers

As he revealed BihorBalogh Eva was sent to court in 2021 by the Prosecutor’s Office attached to the Bihor Court for computer fraud, forgery in documents under private signature and forgery in declarations, after setting up a home care company with fictitious headquarters in the hospital and, between 2015 and 2018, he defrauded dozens of bedridden patients, drawing up files for home care in their names and billing for hundreds of medical services that, in reality, he never provided.

Concretely, Balogh approached the sick or their relatives, took their identity documents, medical documents and health cards, promising them that through his company they would receive free diapers, although in reality their value is not settled by the CAS.

The woman offered them free of charge after buying them with the company’s money, which she recovered in a tenth, in another form. He prepared files for home care in the names of the sick and settled a total of 425 treatments, analyzes and procedures, which he never performed. The money, the investigators showed, was withdrawn from the company by Balogh and spent exclusively in personal interest, for the purchase of a luxury car, jewelry, clothes and food.

With a clean record, but “burnt” in the pockets

During the trial started at the Bihor Court, the judge changed the legal classification of the 425 fictitious settlements from computer fraud to deception, for which, however, the woman could no longer be convicted, as the criminal liability had expired. For this reason, the termination of the criminal process was ordered.

On the other hand, however, the court found the existence of the damage and ordered that Balogh return the damage created to the budget of the Single National Health Insurance Fund, but also the penalties with the related increases, the total value of the damage being evaluated at 377,417 lei, i.e. over 75,000 euros.

The decision of the Bihor Court was upheld, last Friday, also at the Oradea Court of Appeal. “The Court appreciates that the way of conceiving the delict betrays the intention of the defendant-appellant to mislead the civil party relative to the services provided for the purpose of unfairly obtaining patrimonial benefits”, the court decision states.

The decision is final.
