A 2016 dispute regarding the inheritance of a property in Sibiu, which belonged to the wife of President Iohannis, did not receive even a deadline at the High Court of Cassation and Justice (ÎCCJ), although the appeal was registered last September, according to the court’s portal supreme. It is about the litigation regarding the inheritance of a house at 35 Gheorghe Magheru street.

ANAF explains in an answer to G4Media.ro that, due to disputes related to inheritance, it cannot recover another building that belonged to the president, namely the commercial space at 29 Nicolae Bălcescu Street in Sibiu. It also cannot recover the 260,000 euros obtained from the rent by the presidential family. Practically, the Romanian state suffers doubly, every time the recovery is postponed: the commercial space remains unused since 2016, and the money cannot be recovered from the Iohannis family.

In addition, the supreme court classified the file affecting the recovery by ANAF.

The litigation was initiated by Rodica Bastea, a friend from Miami, Florida, of the Iohannis family. She requests the annulment of a certificate from 2008 by which the Romanian state was declared the legal heir of the building at 35 Gheorghe Magheru. Between 1999 and 2008, the house belonged to Ioan Baștea, the woman’s husband, deceased in the meantime, Georgeta Lăzurcă, the president’s mother-in-law, and to Carmen Iohannis, his wife.

So far, Rodica Baștea has lost at the Hunedoara Court and the Alba Court of Appeal. She is represented by the Mușat si Asociatii law firm.

According to ANAF, this inheritance dispute blocks the recovery by the state of another property lost in court by the Iohannis family in November 2015. This is the commercial space at 29 Nicolae Bălcescu Street in Sibiu. Due to litigation, the succession was suspended by the notary public in Avrig.

“In the situation where the case from File no. 939/85/2016 (regarding the house on Gheorghe Magheru 35) will be settled definitively, by rejecting the action regarding the cancellation of the certificate of legal heir issued in the name of the Romanian State, it will be possible to use the provisions of art. 109 para. (4) from Law no. 36/1995 according to which “At the request of the parties, the notary public will be able to reinstate the succession file at any time, if it is found that the causes that caused its suspension have ceased”, says ANAF, the Administration of Public Finances Sibiu, in a response to G4Media.ro dated April 25, 2024
