Chief CJ Gorj: I proved in court with documents that the legislation is violated – GorjOnline

The Gorj County Council won, last week, at the Gorj Court, the trial with the former prefect Iulian Popescu, the control order issued at the beginning of the year being cancelled. The decision of the Gorjeni magistrates is not final. The President of the Gorj County Council, Cosmin Popescu, is convinced that the institution he leads will also win the case with the Gorj Prefecture at the Craiova Court of Appeal.

“The first order that I contested, together with my colleagues from the legal department, from the very beginning, I said that it was an excess of power, it was an abuse of the prefect. We proved in court with documents that the legislation is violated, and the court ruled in our favor, canceling the control order ordered in January by the former prefect of Gorj county. As I have said every time, I do not shy away from any control, I have nothing to hide, my colleagues have nothing to hide, but they have to meet the legal conditions. It would create a dangerous precedent not only for the Gorj County Council, but also for the town halls. The prefect must apply the law as established in the legal norms in force provided by the Administrative Code and other incidental legislation. As you know, it is a first phase, the Court of Appeal will be the one to establish, but, I believe, that the reasoning of my colleagues and the court’s reasoning will be strong enough so that the solution given will be maintained at the Craiova Court of Appeal. I reiterate the fact that I have never hid and I do not hide from controls, but when I see that it is an abuse and excess of power, naturally I oppose it, because it creates dangerous precedents for the local public administration”, says the head of the county.
