The management of the Municipality of Turda is obliged as under art. 33 paragraph (3) of Law 94/1992 to establish the extent of the amounts paid from the local budget representing penalties of 1% per day of delay and the execution costs, generated by the non-implementation of the sentences handed down by the courts and to take measures for the recovery of this money, according to a report of the Court of Accounts of Romania, made public by officials from Turda City Hall. The determination of the amounts is to be made according to the sentences pronounced by the courts and remaining final.

The measure was mentioned in the “Financial audit report on the centralized financial statements of UAT Turda concluded on December 31, 2022” and had to be carried out by March 31, 2024.

According to art. 64 of Law 94/1992, regarding the organization and operation of the Court of Accounts, non-recovery of damages as a result of management’s failure to provide and follow the measures sent by the Court of Accounts, constitutes a crime and is punishable by imprisonment from 3 months to one year or with a fine. During 2022, the Municipality of Turda confirmed following a request based on Law 544/2001 that at that time no measures had been taken to find the culprits nor any action to recover the damage.

Apart from the damage of 6,193,712 lei, the auditors of the Court of Accounts found that 332,349.38 lei were paid from the local budget, representing penalty interest and enforcement expenses as a result of the fact that the final sentences pronounced were not implemented by the courts.

According to the report of the Court of Accounts, the management of the Turda City Hall was obliged to start the procedures to find the culprits and recover the damage caused by March 31, 2024.

The Secretary of Turda Municipality, Elena Mărginean could not be contacted by phone for an official point of view of the institution.

The Court of Accounts noted that on numerous occasions, the Municipality of Turda did not carry out the final decisions of the courts, a fact that created damages to the local budget by paying penalties and execution expenses that cumulatively exceed 6.5 million lei so far.

The Cluj National Anticorruption Directorate is also working on a criminal complaint regarding these aspects. Former local councilor Doru Anca filed a criminal complaint against mayor Cristian Matei for committing the crimes of negligence and abuse of office.
