A beloved folk music soloist from Gorj is demanding moral damages of 50,000 euros from a Google company! Look what happened! – GorjOnline

Through the application registered with the Târgu Jiu Court, in June of last year, the popular music soloist Angela Gheonea sued Google Ireland Limited and Nirela Trivone and requested to oblige them to be removed from the YouTube channel “Party with Romanians – Subject, ,, content uploaded under the name “Nana comes to me”, as well as obliging the defendants to pay the sum of 50,000 euros representing moral damages for the damages caused.

In motivation, the beloved performer showed that she has been a vocal soloist of popular music for about 10 years, she has been active in a group with which she sings at various events (weddings, baptisms, etc.) and in various locations, specifying that she created an account on YouTube channel on 30.10.2015, based on personal email address, being monetized, and has 30,814 subscribers and over 14,327,000 views. Also, Angela Gheonea mentioned that her posts “target live interpretations and recordings of Romanian folklore, choosing this way of promotion, with the aim of sharing resources, information and useful tools for practitioners and enthusiasts of the field, in an area of ​​discussions and debates constructive about various topics in the area of ​​online communication and promotion. He considered YouTube posts as a research and testing ground for various projects dedicated to the field in which he operates, also here announcing communication events, interesting for followers and proceeding to exchanges of experience between them”.

The soloist stated that at 1,000 subscribers and over 40,000 views, he had the right to monetize the channel, that is, to request that an advertisement be placed during the playback of the songs and be remunerated. He opted for this option, but for the least remunerated one, which has only one ad at the beginning of the song, the amounts received monthly are not very high, about 100 euros/month, but these amounts can increase if he opts for the ad during songs, a song longer than 10 minutes, but also depending on the number of followers. Angela Gheonea showed that on May 14, 2021 she uploaded a collage of two songs performed by her vocally, under the name “Serbian game collage”. Two years later she was notified by the “youtube” channel that they received a copyright claim for this collage. The complaint was received from Believe Music, a music uploading domain. At the same time, the plaintiff stated that she made a request through which she showed that there is no copyright on the songs performed, as it appears from an exchange of emails, but her request was rejected.

He filed a new appeal, so on May 12, 2023, Believe Music withdrew the complaint against him. Later, she checked and found “Serbian game collage”, uploaded by her on May 14, 2021, (interpreting the two songs included in the collage) on the YouTube channel “Party at Romanians-Subject”, under the name “Vine nana si la mine” “, which does not specify the artist.

The performer from Rovinari stated that his right to the image was violated, with the possibility of exploiting it from an economic point of view, and filed a lawsuit against Google Ireland Limited, a company that is responsible for providing the majority of Google services in the European Economic Area.

At the court term in January of this year, the Tg-Jiu Court declined its competence to resolve the case and the file will be judged by the Gorj Court, which set the next term only in June.
