The Alliance of Digital Romanians Party asks the General Prosecutor’s Office to initiate the action to dissolve the Alliance Party for the Union of Romanians (AUR) / Dan Diaconescu’s business partner accuses George Simion, among other things, of “belonging to a foreign secret service”

The Alliance of Digital Romanians Party (ARD) submitted, on Thursday, to the Prosecutor’s Office attached to the High Court of Cassation and Justice a request requesting the promotion of an action at the Constitutional Court in order to dissolve the Alliance Party for the Union of Romanians, according to a consulted document by G4Media.ro. The president of ARD, Sorin Voinea, one of the business partners of the former journalist, Dan Diaconescu, sent to court for sex with minors, shows in the action submitted to the General Prosecutor’s Office that the leader of AUR, George Simion, would have violated the constitutional order through statements, facts and actions. The will invokes “statements of an anti-Semitic nature against the Jewish community”, “promotion of neo-legionary ideology”, “physical and verbal violent actions” and “belonging to a foreign secret service”.

Voinea told G4Media.ro that ARD will in the next few days submit a notification to the Central Electoral Bureau and the Permanent Electoral Authority through which it will officially request the refusal to enter the lists of AUR candidates in the electoral competition for the European parliamentary and local elections from June 9 until the resolution of the action filed at the General Prosecutor’s Office. “During the next week, we will request the Foreign Intelligence Service and the Romanian Intelligence Service to address their counterparts in the Republic of Moldova and Ukraine in order to declassify the files that were the basis of the ban applied to George Simion from entering for 5 years on the territory of the two states. These documents will complete the file from the General Prosecutor’s Office”, Voinea also declared.

“REQUEST FOR PROMOTION OF CONTESTATION CONCERNING CONSTITUTIONALITY
ALLIANCE FOR THE UNION OF ROMANIANS POLITICAL PARTY (AUR)

at the Constitutional Court of Romania, according to the provisions of art. 146 letter k) of the Romanian Constitution, art. 43 letter a), art. 44, art. 45 paragraph (1) letter a) and art. 48 of Law no. .14/2003, art. 144 lit. k) from the Romanian Constitution and art. 11 para. (1) Point A, letter f) of Law no. 47/1992, in order to dissolve and delete the political party.
Reasons for the request:

According to the information, declarations, facts and public actions undertaken by Mr. George Nicolae Simion, the president of the Alliance for the Union of Romanians (hereinafter referred to as AUR), serious violations of constitutional orders resulted through:

1. Statements of an anti-Semitic nature against the Jewish community

There are countless public statements of the President of the AUR that have an anti-Semitic character, as this notion is regulated by art. 2 letter a) of Law no. 157/2018 regarding some measures to prevent and combat anti-Semitism: “by anti-Semitism is understood both the perception concerning Jews expressed as hatred against them, as well as verbal or physical manifestations, motivated by hatred against Jews, directed against Jews or non-Jews or their property, against the institutions of Jewish communities or their places of worship”.
Moreover, in art. 3 of Law no. 157/2018 reads as follows: “The act of a person promoting, in public, in any way, anti-Semitic ideas, concepts or doctrines constitutes a crime and is punishable by imprisonment from 3 months to 3 years and the prohibition of certain rights.”

2. Promotion of neo-legionary ideology

The President of AUR George Nicolae Simion induced among the young population (18-35 years) through the social media platform TikTok and within the public actions of AUR neo-legionary messages that lead to the violation of the rule of law and constitutional democracy.

3. Physically and verbally violent actions

The President of the AUR made repeated threatening statements, promoted and encouraged the violent behavior of party members in the headquarters of the Romanian Parliament as well as in many public institutions, facts contrary to the provisions of art. 22 of the Romanian Constitution: “(1) The right to life, as and the right to physical and mental integrity of the person are guaranteed. (2) No one can be subjected to torture or any kind of punishment or inhuman or degrading treatment.”
Also, in article 30 paragraph (7) of the Romanian Constitution it is stipulated that: “The law prohibits (…) incitement to war of aggression, to national, racial, class or religious hatred, incitement to discrimination (…) “.

Or, under these conditions, it is necessary to take into account the provisions of art. 40 paragraph (2) of the Romanian Constitution which shows that: “Parties or organizations that, through their goals or activity, campaign against (…), the principles of the rule of law (…) are unconstitutional.”

The constitutional notion of “principle of the rule of law” means, according to article 6 paragraph (2) of the Romanian Constitution, that: “The protection measures taken by the state for the preservation, development and expression of persons belonging to national minorities must be in accordance with the principles of equality and non-discrimination in relation to other Romanian citizens.”

Thus, the anti-Semitic statements of the President of the AUR are a violation of the principle of non-discrimination from article 6 paragraph (2) of the Romanian Constitution.

4. Belonging to a foreign secret service

There is public information that confirms the suspicion that AUR leader George Nicolae Simion was kidnapped in Chernivtsi (Ukraine) in 2011 by an important foreign intelligence service of a country outside the European Union.
This information was validated, by public assumption, by the Prime Minister of the Romanian Government, Mr. Marcel Ciolacu.

In the jurisprudence of the Constitutional Court, by Decision no. 555/2021, it was established that the role of the Public Ministry is to represent the general interests of society and to defend the legal order, as well as the rights and freedoms of citizens, according to art. 131 par. 1) from the Romanian Constitution.

The Constitutional Court established that the Public Ministry exercises an active role in the procedure regarding the activity of political parties from their establishment, dissolution and deletion.
In order to prove what has been shown in the appeal request, we request the administration of the following means of evidence: records, witnesses, material means of evidence and any other means provided by law.”

Sorin Voinea “from Jiu”, the president of the Alliance of Digital Romanians, said on Friday for G4Media.ro that “ARD opens the list for the European Parliament with Dan Diaconescu. He is not prohibited from running in Europe, only in Romania! We will be the surprise of the 2024 elections.”

Dan Diaconescu was sentenced to 5 and a half years in prison with execution for blackmail in 2015 and was released after almost 3 years. However, he is prohibited from being appointed to public positions and from exercising his profession as a journalist. He is currently being arraigned in another case, accused of having sex with minors.

Diaconescu was close to the AUR, a fact emphasized even by the leader of the extremist group George Simion, who made several posts last year about the relationship between the two, but the relationship with the AUR leader would have cooled, relatives of the former told G4Media.ro journalist.

Voinea claims that she will submit the list to the Permanent Electoral Authority in the next period, after collecting all the signatures.

Sorin Voinea “Delajiu” presents himself as the leader of “the first digital party in Romania, legally established, based on artificial intelligence” and claims that former journalist Dan Diaconescu will run under the DDD logo. “If until now it was Dan Diaconescu live, now it will be Dan Diaconescu Digital”, Voinea also said.

Dan Diaconescu was placed under house arrest for 30 days, on April 7, 2023, following a decision of the Constanța Court. The former journalist spoke about “a lynching”: “It was a legal staging. I don’t want to remember anymore (…) I hope that in the shortest time the whole country will see that I am innocent”.

Dan Diaconescu is accused by the prosecutors of allegedly having sexual relations with minors in 2020 and 2021. Diaconescu is accused of “consensually and repeatedly having sexual relations and oral sex acts, against sums of 300-400 lei, with two minor injured persons, twin sisters, aged 15, who turned 16 in July 2021”.

On November 22, 2023, the Constanța Court rejected all requests and exceptions of Dan Diaconescu and ordered the trial to begin in the case of the former TV producer.
