It becomes mandatory in Romania! Our country has to transpose into national legislation an important directive that was adopted by the EU. The normative act requires member states to issue a single permit for work and residence. What it is?

The European Union has adopted a directive requiring member states to issue a single work and residence permit. It is Directive 2024/1233. This revitalizes and simplifies the provisions of a directive from 2011. The aim is to facilitate the process of admission and integration of third country nationals in the member states.

The recently adopted directive must be transposed by 2026. It establishes an administrative procedure for obtaining a single permit. This unique permit gives both the right to work and the right to stay in the EU. It establishes a common set of rights for workers from third countries.

Directive on a single permit for non-EU workers

Until now, the member states of the European Union have had divergent rules and procedures for the admission and residence of non-EU workers. This led to a fragmented and complicated system.

The new directive aims to remedy this situation by introducing a single application procedure and a common set of rights. The aim is to ensure equal treatment and facilitate the integration of workers into the European labor market.

This initiative is crucial to maintaining the attractiveness of the European Union for skilled workers from outside the bloc. It has a positive impact on economic growth and reducing labor shortages in certain sectors.

Romania must transpose these regulations into national legislation

Also, the single permit directive aims to promote a fairer and more effective migration policy. It must be carried out in accordance with European values ​​regarding fundamental rights.

Romania, as an EU member state, must transpose these regulations into national legislation. Our country has set a deadline of 21 May 2026. This involves adjusting existing procedures and legislation. It is therefore necessary to comply with European standards and to protect the rights of workers from third countries.

Fair treatment for workers from third countries

These provisions are based on the principle of guaranteeing fair treatment for workers from third countries, covering aspects related to:

  • working conditions,
  • equal treatment,
  • access to protection mechanisms against abuses.

According to the Council of the EU, a third country worker can submit an application from the territory of a third country. If you are the holder of a valid residence permit, apply for this from EU territory.

If a Member State decides to issue this single permit, the decision will serve as both a residence permit and a work permit.
