The 38-year-old man from Spinuş who raped the 11-year-old daughter of his concubine was sentenced to 6 years in prison by the Marghita Court. The victim gave birth to a child as a result of the abuse, and the rapist, Petru Rusalim Varga, was released by the prosecutors in Marghita who requested his arrest only after the BIHOREAN reported the scandalous decision.
The little girl’s story was revealed on December 15 last year by Bihorimmediately after her aggressor, detained by the prosecutors in Marghita, was allowed to leave after the hearings, without any other preventive measures being taken against him.
The investigator in the case, prosecutor Alexandru Lup, cited for the release the fact that he does not have proof that the girl did not give her consent for the sexual act and, as such, he does not consider it appropriate to ask the court for preventive measures.
One day after the revelations made by the newspaper, the girl was urgently hospitalized by the representatives of DGASPC Bihor in a reception center for abused minors, together with her child, and the prosecutor Lup changed his mind – or “he changed his mind” – and presented Petru Rusalim Varga before the judge of rights and liberties at the Marghita Court, who issued a preventive arrest warrant on his behalf.
Varga remained behind bars even after he was sent to court, on January 5, this year, on charges of raping a minor victim under his care.
According to the indictment drawn up on the man’s behalf, he assaulted the girl three times over the course of several months. The first time, when she was 11 years old and he had normal sexual intercourse with her, then becoming pregnant, and later, after she turned 12, he raped her twice, each time having anal intercourse with her.
The girl gave birth last fall. Moreover, the apprehension of her abuser was made after the DNA results arrived which showed that he is undoubtedly the child’s father.
“The victim did not directly express his opposition or physical opposition, because he was afraid of his reaction. The defendant told him several times not to tell anyone about the fact that he had several sexual relations with her, this warning being sent to the minor even before she was questioned by the police,” the prosecutors said.
Petru Rusalim Varga’s trial began at the Marghita Court, which, on Monday, decided to sentence him to 6 years in prison for his deed.
At the same time, the court forbade him to communicate with the girl both during the period in which he is serving his sentence, but also afterwards, for 5 years.
The court also admitted the civil action brought ex officio by the prosecutors, in favor of the little girl, and they forced Varga to pay moral damages in the amount of 50,000 lei, an amount for the recovery of which the court ordered the application of the insurance seizure on the man’s assets.
The decision of the Marghita Court can still be appealed to the Oradea Court of Appeal.
