5,000 lei fine and cleaning of the land

At the beginning of this month, the newspaper Turnul Sfatului showed that the landscape of Sibiu is littered with tons of rubble and waste thrown on the side of the road, in Dealul Dăii.

The panorama of Sibiu is polluted by a huge amount of construction waste, systematically thrown on the side of the county road that connects Sibiu to Agnita. Tons of construction debris is visible from the asphalt in several places commonly used by those who want to get rid of the debris.

Following the article in Turnul Sfatului, both the County Commissariat of the Sibiu Environmental Guard and the representatives of the Roșia City Hall – within the radius of which the waste is located, went to the site.

“On the occasion of the control on April 8, three locations were identified (on the right side of DJ 106 Sibiu – Agnita, after the Bavaria Quarter and the Heroes’ Cemetery area) where construction and demolition waste is stored mixed with recyclable waste, a fact for which by Finding Note no. 109/08.04.2024, Roșia City Hall was required to identify the owners of the land where these waste deposits were found, as well as the written expression of a point of view of the urban planning department regarding the need to request and obtain the regulation of the works detected”, the leadership of the Sibiu Environmental Guard County Commissariat sent to the editorial office.

Three days later the City Hall of the Roșia commune informed the Environmental Guard – CJ Sibiu who are the owners of the respective lands, but “without specifying their contact details, as well as the fact that they did not request a point of view or an urban planning certificate from the City Hall” .

In a short time the commissioners of the Environmental Guard identified one of the owners of the land where there are storages of inert materials (especially in the front part of the land) as well as quantities of construction and demolition waste (rubble, brick, plaster, concrete, tile) mixed with plastic material waste (foil packaging, plastic containers), paper-cardboard packaging, vegetated waste – wood, in the back part of the land, the area affected by the mixed waste being approximately 500 square meters.

“As such, the owner of the land affected by waste dumps – the natural person, was penalized for not taking measures to clean up the land owned by any title, not productively or functionally occupied, especially those located along road communication routes according to Art. 94, paragraph 1, lit. r) from GEO 195/2005 on environmental protection, with subsequent amendments and additions, with a fine of 5,000 lei, according to Art. 96, paragraph 1, point 10 of the same normative act. At the same time, remedial measures were imposed on the owner of the land, such as the sanitation of the site of recyclable waste by sorting and handing it over to authorized units for the collection of this waste with the preservation of supporting documents and the prohibition of storing or abandoning any type of waste”, the chief commissioner of Sibiu Environmental Guard, Elena Anghel.

Next, the GNM CJ Sibiu commissioners are taking steps to identify the contact details of the other holders or owners of land where waste was deposited, and they will be fined.
