Simona Bucura-Oprescu explained which Romanians will be able to retire earlier, according to the new pension law that comes into force on September 1, 2024.

One of the main changes in the new pension law refers to the types of pensions that will be granted to Romanians. Specifically, one of these categories disappears.

It is early retirement without penalty.

At this moment, the early pension without penalties can be obtained a maximum of five years before reaching the standard retirement age, provided that a contribution period of at least eight years greater than the full contribution period has been achieved.

On the other hand, the early pension with penalties can still be obtained a maximum of five years before reaching the standard retirement age, but it is only necessary to complete the full contribution period (those who exceed the full period by up to eight years are also eligible), writes avocatnet.ro

In other words, currently, the difference between the two consists in the fact that, for the pension without penalties, a longer period of work is needed than for the pension with penalties. However, the amount of pension with penalties is lower. From September 2024, however, the early retirement rules will be slightly different, among other changes set for public pensions.

Romanians who will be able to retire earlier

However, there are many Romanians who will be able to retire earlier and after the implementation of the new pension law.

“The new pension law is a success of the Government. Including with regard to the special and special working conditions, because Romania, through the PNRR, committed that it will give up the possibilities of early retirement, that we will no longer encourage early retirement, which led to a very low average retirement age in the public pension system pensions in Romania.

And in the new law, we maintain the special and unique working conditions until 2035, giving employers the opportunity to normalize these conditions, that is, by upgrading the workplace and the working conditions at that workplace no longer represent a danger to the health and safety of the employee and employers have 12 years, until 2035, so that they have the necessary time for normalization”, said Simona Bucura-Oprescu, on Sunday, on Romania TV.

The Minister of Labor also explained that those who work under special conditions will continue to benefit from pension benefits.

“Regarding the benefits that retirees have, both in special conditions and in special conditions, but also surface miners, underground miners, those in radiation areas. Here I had repeated negotiations both with you and with the Commission. To a large extent, they still benefit.

That is, as far as underground miners are concerned, the retirement age reduction remained the same, with 20 years, as it is now. Regarding the reductions to general conditions, we have the same group increase that we had before, six months for special conditions, as well as four months for special conditions, these have remained.

We have an additional score for miners of one point per year, under special conditions of 0.5 points per year, for them we have a reduction of the retirement age by 10 years. It is true that in the old law, 263/2010, the reduction was 13 years, now it has decreased from 13 to 10 years, under special conditions the reduction was 10 years, now it has decreased from 10 years to 7 years”, he explained she.
