Boc’s town hall, humiliated in the LOMB process, will cost us all 10 million lei

The City Hall of Cluj-Napoca lost at the Cluj Court of Appeal the case related to the association for the Lomb project, which involved the construction of affordable housing for young people. A few years ago, Cluj-Napoca City Hall partnered with Impact Developer&Contractor SA for a project to build youth housing on Lomb Hill, but the project stalled and was shelved. Dissatisfied that the City Hall would not have respected its contractual obligations, the company sued the local administration in court.

The trial lasted several years, and now the Court of Appeal has found the private partner’s claims to be well founded. Therefore, the sentence confirms that the municipality did not fulfill its obligations and, as such, it is liable to pay.

4,597,447.38 lei moral damages, plus interest 5,454,461.52

The price we will all pay as a result of the fact that Cluj-Napoca City Hall lost this trial is more than 10 million lei, for moral damages-4,597,447.38 leiinterest greater even than damages- 5,454,461.52 lei, to which are added the court costs on the merits-291,675.57 lei and on call- 58,089.79 lei.

The decision of the Cluj Court of Appeal is final and enforceable. Cluj-Napoca City Hall has 15 days if it wants to appeal to the Court of Appeal.

Here is the sentence given by the Cluj Court of Appeal against the City Hall of Cluj-Napoca in the trial regarding the association for the Lomb project

Rejects the appeal declared by the appellant company IMPACT DEVELOPER & CONTRACTOR SA, in opposition to the respondents CLUJ-NAPOCA MUNICIPALITY and the LOCAL COUNCIL OF CLUJ-NAPOCA MUNICIPALITY, against the conclusions of the meeting of 22.02.2016, 28.11.2016, 30.10.2017, 05.06.2019 and 18.11.2020, all pronounced by the Cluj Specialized Court in file no. 79/1285/2012. Accept the appeal declared by the appellant company IMPACT DEVELOPER & CONTRACTOR SA in opposition to the respondents CLUJ-NAPOCA MUNICIPALITY and CLUJ-NAPOCA LOCAL COUNCIL, against civil judgment no. 2013/23.12.2020 and civil judgment no. 381/24.02.2021, both pronounced by the Cluj Specialized Court in file no. 79/1285/2012, which they change in everything, in the sense that: Admits the summons request, as stated, formulated by the plaintiff company IMPACT DEVELOPER & CONTRACTOR SA in contradictory with the defendants CLUJ-NAPOCA MUNICIPALITY and CLUJ-NAPOCA LOCAL COUNCIL and, consequently: Orders the termination of framework contract no. 55423/04.07.2007 concluded between the Local Council of the Municipality of Cluj-Napoca and the company Impact Developer & Contractor SA Obliges the defendants to pay to the plaintiff the amount of 4,597,447.38 lei as compensation, as well as to pay the related legal interest in the amount of 5,454,461.52 lei calculated for the period 01.09.2010-13.09.2022, with the related legal interest to be calculated further until the actual payment of the principal debt. It obliges the defendants to pay to the plaintiff the sum of 291,675.57 lei as court costs incurred on the merits. It obliges the respondents to pay to the appellant the sum of 58,089.79 lei as court costs in the appeal. Definitive and enforceable. With right of appeal within 15 days of communication. The appeal request is submitted to the Cluj Court of Appeal. Pronounced today, April 23, 2024, in public session.
