The European Commission sanctions Romania due to delays in payments to independent pharmacies. The infringement procedure is ongoing because the payments have not been made.

The EU sanctions Romania due to non-payments to pharmacies

The European Commission decided, on Wednesday, April 24, to initiate a procedure for violating the rules by sending a notice of delay to Romania, according to information published by Agerpres.

The decision comes because of non-compliance with the provisions of Directive 2011/7. This is aimed at preventing delays in making payments in transactions that are commercial, according to a press release published by the European Executive.

In other words, delays in making payments have a negative impact on the liquidity flow of companies and, above all, complicate their financial situation.

They also affect the competitiveness and profitability of firms, as creditors are forced to seek external financing due to late payments.

Romania has one month to make the payments

According to Directive 2011/7, public authorities are obliged to pay invoices within 30 calendar days, but this term can be extended up to a maximum of 60 days for public authorities providing medical services.

The Commission decided to send a notice of delay to Romania because public health authorities are significantly delaying payments to independent pharmacies for medicines supplied to patients through the national health insurance system.

Being directly responsible to the distributors and other parts of the supply chain for their delays, these payment delays endanger the viability of independent pharmacies in Romania, the quoted statement states.

Romania now has two months to respond and remedy the deficiencies reported by the European Commission, otherwise it risks receiving sanctions.

In the absence of a satisfactory response, the Commission may decide to issue a reasoned opinion, which is the second stage of the infringement procedure.
