Sentenced to two years in prison for an accident resulting in the death of a minor – GorjOnline

A Gorjean man was sentenced to two years in prison for manslaughter. He drove a tractor that was involved in an accident, as a result of which a minor lost his life.

“Consolidates the prison sentences applied and applies the heavier penalty of 1 (one) year and 9 (nine) months in prison to which is added an increase of 3 months, representing one third of the amount of the other established penalties, the defendant will serve the resulting penalty of 2 (two) years in prison. (…) orders the suspension of the execution of the sentence under supervision and establishes a term of supervision of 3 (three) years for the defendant, a term that will begin to run from the finality of this sentence”, decided the Motru Court.

Dumitru Dragoș Băzăluica drove the tractor and allowed a minor to be transported, although he was not provided with adequate space: “As a driver, through fault, he did not respect the legal provisions regarding traffic on public roads, in the sense that he drove a the assembly consisting of a tractor and a semi-trailer, which did not correspond from a technical point of view to be driven on public roads, and the defendant allowed the minor to be transported in the driven tractor (…), in the undeveloped space behind the driver, the tractor not being provided in the construction with seats for transporting passengers, non-compliance which led to the occurrence of a traffic accident resulting in the death of the minor, an act that meets the constitutive elements of the crime of manslaughter”, the prosecutors established.
