The woman worked as a carer in Umbria and died in a road accident. According to the civil justice decision, the two sisters remaining in Romania are entitled to compensation.
The judges of the civil section of the Court of Appeal in Perugia changed the initial decision, accepting the request of the relatives, after the first instance sentence had excluded the Romanian sisters from the right to compensation.
The trial judge insisted on the fact that the two women, who lived in Romania, did not prove “the existence of relationships of affection and mutual solidarity” with the woman who died in the accident.
“Mere geographical distance does not exclude the existence of a close emotional relationship”
However, the appellate judges decided the opposite: “in the absence of evidentiary elements on the basis of which it can be assumed that the relatives are indifferent to each other, and the simple geographical distance does not exclude the existence of a close emotional relationship”.
The judges of the Court of Appeal recognized “the existence of the right to compensation for the sisters of a person who died in Italy during a road accident”.
Considering that the fact that they lived in Romania and in different and distant places is not enough to exclude the relationship of mutual affection and solidarity with the deceased family member.
Reason for the decision:
Until now, Italian courts did not offer financial compensation to the relatives of road accident victims, if they were not resident in Italy, considering that the emotional bond between the victim and relatives at a great distance is weakened by distance.
