Five policemen from IPJ Alba escaped a criminal case for forgery and deception, after they illegally settled the value of some tourist services that they did not benefit from in reality. The prosecutor from the Public Prosecutor’s Office attached to the Alba Court who conducted the investigations considered that it was sufficient for each of the 5 to perform 30 days of community service.

The Alba Iulia Court found “the legality and validity of the decision to withdraw from the criminal investigation” ordered by the prosecutor’s order dated February 20, 2024. One of the 5 is currently retired.

“The evidence administered in the case reveals that the suspects, having the capacity of non-commissioned police officers, benefited in 2020 from the direct settlement by the employer of the counter value of the tourist services, within the limit of the amount of 1,450 lei (they did not receive holiday vouchers in script format or on a card ). Practically, they paid from their own funds the counter value of the tourist services, then, based on the invoice and tax receipt issued by the provider, they requested the payment of the amount by the employer.

It was shown that, in 2020, based on invoices issued falsely by (…), the suspects requested the settlement of tourist services in the amount of 1,450 lei by IPJ Alba, which, based on the submitted documents, paid them these amounts. It was stated that, in reality, from the administered evidence (witness statements, suspects, transcripts of replays of intercepted telephone conversations) it emerged that the suspects were not accommodated at (…) during the periods mentioned in the submitted documents.

Moreover, IPJ Alba communicated that the damage caused by the suspects has been fully repaired and that there is no civil party in the case”. it is stated in the conclusion of the Alba Iulia Court, consulted by ziarulunirea.ro

In the case of one of the policemen, only the form of the attempt was retained, because the institution did not pay the requested amount. The investigations concerned acts of incitement to the crime of forgery in documents under private signature, use of forgery, fraud and attempted fraud.

The representative of the company that issued the invoices stated that the police officers were not accommodated in the accommodation structure that it owns.

“The judge of the preliminary chamber, in relation to the content of the deed, the manner and means of its commission, the intended purpose and the concrete circumstances of its commission, the consequences produced or that could have been produced by the commission of the crime, the efforts of the necessary criminal investigation bodies for the conduct of the criminal trial by reference to the seriousness of the act and the time elapsed since its commission, the existence of a clear disproportion between the expenses that would be involved in the conduct of the criminal trial and the seriousness of the consequences produced, finds that there is no public interest in pursuing it” , it is mentioned in the closing of the Alba Iulia Court.
