File for manslaughter, in the case of Dr. Demetrian’s patient from Caracal – Oltenia regional news

--

The patient from Caracal who, in April, arrived at the hospital in a serious condition, after an intervention performed on her by Dr. Alin Demeterian, former head of the Craiova County Emergency Clinical Hospital (SCJU), at a private clinic, has died. Law enforcement officers are now investigating the case for manslaughter. For now, on the fact, not on the surgeon.

“In the continuation of the investigations regarding the event that occurred in the evening of April 4 this year, as a result of which a 52-year-old woman, from the municipality of Caracal, Olt county, allegedly went into cardio-respiratory arrest following an endoscopic exploration intervention, at 03.05 .2024 her death occurred. Considering the evidence administered so far, in conjunction with the preliminary medico-legal conclusions, as well as the suspicion of a case of medical malpractice, the investigations will be continued under the aspect of committing the crime of manslaughter, and upon their completion, a thorough solution will be proposed and legal, through the competent prosecutor’s office”, said Cristian Grigorescu, spokesperson of the County Police Inspectorate (IPJ) Dolj.

We remind you that, last month, a 52-year-old woman from Caracal arrived at SCJU Craiova in a serious condition, following an endoscopic exploration intervention performed by doctor Alin Demetrian, at a private clinic in the city.

“The police officers of the Dolj Criminal Investigation Service reported that, on the evening of April 4 this year, a 52-year-old woman from the municipality of Caracal, Olt county, allegedly went into cardio-respiratory arrest following a endoscopic exploration interventions, performed by a man from the municipality of Craiova, a surgeon”, said the police officers from IPJ Dolj.

Alin Demetrian, former manager of SCJU Craiova and former head of the Thoracic Surgery Section of the medical unit, is one of the best-known surgeons in Craiova. He was successful in operations for the first time in the country, on patients with lung tumors. Now he is accused of making fatal mistakes in the interventions. In January of this year, he was sent to court for manslaughter.

“On 13.09.2019, as the main operating physician, performing his duties at the Craiova County Emergency Clinical Hospital, as a result of non-compliance with the measures stipulated for the exercise of the medical profession, thoracic surgery specialty, Demetrian Alin- Dragoş improperly performed a Carlens-type anterior cervical mediastinoscopy on the BD patient during which he accidentally severed the patient’s right brachiocephalic trunk, causing a massive external hemorrhage that led, on the morning of 09/14/2019, to the violent death of the patient, between the medical act performed by the defendant and the death of the patient there is a direct causal link”, according to the prosecutors from the Public Prosecutor’s Office attached to the Craiova District Court.

In addition, the prosecutors also show, through the same indictment, it was ordered to sever the case and carry out investigations against the surgeon Demetrian, as a suspect, for “committing, in similar circumstances, three other crimes of manslaughter as a result of medical malpractice” .

Last year, the doctor was detained in a similar case. The woman is hospitalized in the ATI section of SCJU Craiova, in serious condition. The Dolje police officers are now conducting investigations to establish the exact circumstances in which the event took place, and legal measures will be ordered.

The doctor is under judicial control. After the case of the patient from Caracal, the investigators asked the court to replace the judicial control with another, more drastic preventive measure, a request rejected by the Craiova Court. The doctor Alin Demetrian would not have violated the provisions of the judicial control that forbade him to operate only in cases that had a direct connection with the four patients who died, according to vertuen.ro.

“Through the decision issued on 25.04.2024, the Craiova Court rejected as unfounded the request made by IPJ Dolj, assessing as a consequence that Dr. Alin Demetrian fully complied with the obligations established by the court, the bronchoscopy intervention performed not being part of those surgical interventions which had been forbidden to him. It is important to mention that during this examination of the legality and merits of the request, the court also analyzed whether during the surgical intervention performed, the doctor complied with the protocol established by the County Emergency Hospital no. 1 from Craiova in bronchoscopy interventions, not identifying any deviation from this protocol”, said the lawyer for the quoted source, Daniel Oțel, the lawyer of doctor Alin Demetrian.
