This decision comes as a result of a self-referral by the Judicial Inspection and is based on suspicions of affecting the impartiality of disciplinary procedures and of harming the prestige of justice.

Following the request to postpone the judgment made by Ioana Ancuța Popoviciu last week, the Section decided to postpone the trial of the case in order to guarantee her right to defense.

The Judicial Inspection proposed the suspension of judge Ioana Ancuța Popoviciu from the judiciary on April 16, reasoning that continuing to exercise the position could affect the impartial conduct of disciplinary procedures and could harm the prestige of the judiciary.

The checks on the magistrate’s behavior in the courtroom began in February, after the information appeared in the public space about the February 22 court hearing at the Mangalia Court, where Ioana Ancuţa Popoviciu is a judge.

If the Superior Council of the Magistracy approves the request of the Judicial Inspection, judge Ioana Ancuța Popoviciu will be suspended from office until the completion of the disciplinary investigation.

This decision would lead to the resumption of Vlad Pascu’s trial from the first term, according to legal procedures. The move comes after several incidents in the courtroom, including unusual questions from the judges to the victims’ families.

At the end of that court session, the father of one of the young people who died in the accident stated that the judge asked if his boy was in the courtroom. “He told me if my boy was in the courtroom. I have never seen such a judge in my life. He wanted his report card,” he said.

Also, another parent stated that the judge appeared unprepared for the court hearing and was chewing gum.

On October 11, 2023, the prosecutors of the Prosecutor’s Office attached to the Mangalia Court announced that Vlad Pascu was sent to court, in a state of preventive arrest, for committing the crimes of culpable homicide, culpable bodily injury, driving a vehicle under the influence of alcohol or other substances and leaving the scene of the accident.

“The defendant was charged that, in the morning of 19.08.2023, he drove a vehicle on public roads, under the influence of psychoactive substances, and, upon entering the town of 2 Mai, hit a group of people who were walking on the side of the road .

As a result of the impact, the named OAS (21 years old) and DRM (20 years old) died, as well as the bodily injury of the named BDD (18 years old), CVA (20 years old) and ICI (20 years old). It is also noted that, after the accident, the defendant left the scene of the accident,” the prosecutors said.
